이 논문은 경기력 향상을 위한 금지약물 복용의 불공정성에 대한 윤리적 근거를 제시하려는데 있다. 금지약물 복용은 어떠한 경우에도 허용되어서는 안 된다. 왜냐하면 스포츠의 본성이 공정한 경기이여야 하며, 따라서 공정성을 파괴하는 것은 어떠한 수단과 방법도 용납되어서는 안 되기 때문이다. 그러나 금지약물 복용에 대한 경기 수행자들의 승리에 대한 유혹이나 스포츠 관계자들의 상업적 입장에서의 강요는 도핑을 부채질하고 있는 것이 또한 현실이다. 물론 스포츠의 공정성에 대한 논의가 분분한 것은 주지하는 바이다. 혹자는 공정성 이론이 스포츠에서 약물 사용을 규제할 수 있는 정당성과 설득력이 매우 빈약하다고 지적하는 이들도 있다. 즉 약물복용을 금지함에 있어 그 쟁점들은 적어도 각 쟁점마다 일관성과 논리성의 문제가 제기 될 수 있기 때문이다. 만약에 경기력 향상을 위해 금지된 약물을 복용하는 것이 도덕적인 문제와 연관된 것이라고 한다면 우리는 그러한 약물에 대하여 금지의 타당 근거를 밝혀야 한다. 논자는 그 근거를 주로 불공정성에 있다는 것을 밝히면서 스포츠에서의 공정성 규범의 의미와 윤리적 관점에서 공정성의 원칙 그리고 공정한 경기의 의무를 밝히고 있다. 이러한 원칙과 의무는 스포츠 경기 수행에 있어서 당위적일 수밖에 없고 스포츠의 규칙 준수의 근거라고 본다.
Abstract
This paper deals with the conception of fairness as fair play in relations to the problems of doping in sports ethics. In this paper my opinion is that for improving on competition performance, conducts that the athletes take some prohibited drugs including blood doping is unfair. The reason why is that the nature of sports should do fair play, so all of act in violation of fairness can be totally unacceptable. To argue for this ethical point of view, I based my conclusion on the principle of fairness and the duty of fair play.
