이 연구는 도핑검사 과정에서 나타날 수 있는 공정성 문제를 다양한 관점에서 논의하고 새로운 방안을 제시하는 데 목적이 있다. 이러한 목적을 달성하기 위해 먼저 도핑검사를 정의의 관점에서 해석하였는데, 평균적 정의에 가까워지기 위해 노력은 하고 있지만 다소 부족함을 알 수 있었다. 다음으로 스포츠 규칙의 관점에서 도핑검사를 해석하였다. 구성적 규칙에 도핑검사가 포함되기 위해서는 전수검사가 진행될 필요성이 있는데, 현재의 상황에서는 규제적 규칙에 포함되기에 허점이 있다는 것을 알 수 있었다. 이러한 논의를 바탕으로 이 연구에서는 도핑검사의 문제를 보완하기 위해 첫째, 분배적 정의 대상의 확대 및 일관화, 둘째, 규정에 포함된 대상까지 검사 대상의 확대 고려, 셋째, 스포츠 외적인 요소에서도 도핑검사가 진행되고 있는 상황을 참조하여 스포츠에서도 많은 노력을 기울일 필요가 있다는 반성적 사고의 중요성을 강조하였다. 이러한 노력이 이루어진다면, 공정성이 확보된 도핑검사가 이루어는 데 기여할 수 있을 것이다.
Abstract
The purpose of this study is to examine fairness issues in the doping test process from multiple perspectives and to propose new measures. To achieve this goal, the doping test was first interpreted from the perspective of justice, and although efforts were being made to get closer to the average justice, it was found that it was somewhat insufficient. Next, doping tests were interpreted from the perspective of sports rules. In order to include doping tests in the constituent rules, a total inspection must be conducted, but in the current situation, it was found that there were loopholes in being included in the regulatory rules. To address these gaps, the study emphasizes the need for reflective thinking, highlighting the importance of applying strict standards from non-sport contexts enhancing fairness in sports doping controls. These efforts may contribute to establishing a doping test process that ensures fairness.
