간디는 변호사와 사회운동가로서의 경험에 근거하여 경험주의적이고 실용주의적인 사고방식에 의하면서도 도덕주의에 근거해 모든 계급의 화해주의 내지 공존주의적인 법사상을 형성했고, 그로부터 비폭력주의적인 아나키즘 법사상을 도출했다. 간디는 서양문명에 비판적이었으면서도 개인을 존중한 개인주의자이고, 귄리를 의무와 함께 중시했으며, 개인의 자유와 사회의 자치 그리고 동물을 포함한 자연의 권리를 인정했다. 인권을 침해하는 악법에 대한 시민불복종과 신탁이론을 수립하고 이를 헌법구상에 반영한 간디의 정치적 이상은 ‘계몽된 아나키 상태’였다. 그가 추구한 마을 민주주의는 인도헌법에서 마을의회를 규정하는 것으로 나타났고 그가 구상한 인권체계와 자연보호는 어떤 헌법보다도 인도헌법에서 확고하게 명시됐다.
Abstract
On the experiences as a solicitor and a social activist, Gandhi had developed his legal thought of anarchism. It was based on empiricism, pragmatism, moralism and non-violence. Gandhi’s anarchism was not lawless, but non-violence against evil laws which violate human rights. Gandhi was against western civilization, but an individualist who esteemed right and duty, individual freedom, social autonomy, and natural rights. Gandhi developed civil resistance against bad laws and trust theory, and reflected them on Indian Constitution. Gandhi’s political goal was an enlightened anarchy state. Gandhi thought that there was no society without state, but it would be possible in India. Gandhi’s village democracy was reflected as village council on Indian Constitution, and his vision of human rights and natural right was clarified on Indian Constitution. In those points, anarchism principle of freedom, autonomy and nature were embodied on Indian Constitution. Gandhi’s legal thought is more suggestive on our legal thought which gave undue value to western legal thoughts.
