진보정치적 과제로서 형사정책

Criminal Justice Policy as the Political Task of the Left

초록

보수정치가 설정한 안전의제에 대응하여 진보적 형사정책은 범죄와 형벌을 진보정치적 의제로서 설정한다. 사회적 배제의 정치에 맞서 민주적 참여와 사회보장을 통한 공생을 정책방향으로 삼는다. 보수정치의 형사정책이 형벌을 확대강화하면서 소모하는 사회적 자원을 공생을 위한 사회보장정책으로 돌리고, 형사사법제도와 인력을 확대하기보다는 시민의 민주적 참여를 통해 사회적 안전망을 개선하고자 한다. 즉 범죄와 형벌의 문제는 시민의 참여 확대를 통해 민주주의를 강화하고, 빈민과 약자가 범죄와 형벌의 악순환 속에서 사회로부터 배제되지 않도록 사회보장을 실현해야 하는 문제다. 사회적으로 배제된 계층이 범죄와 범죄피해의 질곡에서 벗어나 공동체의 일원으로 함께 살아 갈 수 있도록 사회복지 안전망을 구축하고, 지역사회의 범죄문제 해결에 시민의 참여를 보장하여 범죄에 대한 막연한 두려움을 줄이고 안전감과 안전체계에 대한 신뢰를 회복한다면, 진보정치의 안전정책 내지 형사정책은 지지와 신뢰의 대상이 될 것이다. 범죄와 불안을 배제와 격리가 아닌 사회적 공생을 통해 해결하려는 올바른 정치에 입각한 진보적 형사정책의 전략과 실천이 필요하다.

Abstract

Recently, the Law and Order politics in Korea shows its shift into the politics of security. As an agenda of the leftist politic, the policies on crime and punishment can contribute to build confidence on the politics of the left by way of addressing security issue from the left realist approach. The value and principle of the left politics should be applied to criminal justice policies, which should propose an alternative to exclusive criminal justice policy. Criminal justice policy for social inclusion has its stance against social exclusion, from the perspectives of left realism. Its agenda of the political left is people’s participation and social security for promoting social inclusion. While conservative politics of Law and Order tackles crime by populist punitivism, the left realist criminal justice policy builds its security network against crime upon social security and community justice. The goals of tackling social exclusion are to reintegrate those excluded back into society, to deliver basic minimum standards in health, employment and to tackle crime. The New Labour party of the UK shows a prominent model of policies against social exclusion, such as the Social Exclusion Unit, and Crime Reduction programmes, Crime and Disorder Reduction Partnership, and neighbourhood warden.
