한정된 천부자원인 토지의 소유・사용에 관한 우선권을 특정인에게 부여하는 제도는 대표적인 특권적 제도이다. 이 글에서는 우선, ‘평등한 자유’라는 전제로부터 토지원리를 도출하고, 토지원리에 포함된 ‘지대 공유’는, 일부의 오해와는 달리, 사유재산제와 시장경제의 필수조건임을 밝힌다. 그리고 토지사유제가 이미 정착되어 있는 현실 사회에서 지대 공유 개혁을 연착륙시킬 수 있는 전략을 제시하고 지대세 수입 활용 방안에 대해 검토한다. 마지막으로, 토지공개념은 지금도 합헌이지만 소모적 논란을 잠재우기 위해 헌법에 명시할 경우에 대비하여 구체적인 개헌안을 제시한다.
Abstract
As land is naturally endowed and limited in quantity, any exclusive land right is privilege. If we are to recognize land rights without violating the axiom of equal freedom, public collection of land rent is inevitable. Although the rent collection is market-friendly, its sudden introduction would kick off bitter disputes surrounding compensation to current landowners and also could give harmful impacts to economy due to tumbling land price. So, the paper suggests a soft-landing strategy to collect annual rent after deducting the interest of purchase price of the land. The paper also discusses about appropriate uses of the collected rent. In addition, the paper suggests revision of land clauses of the current Korean constitution as an alternative to those submitted by President Moon Jae-in in 2018.
