군인의 자살과 책임법리의 재정립

초록

이 글의 목적은 군인의 자살에 대한 공동체의 책임을 강화하려는 데에 있다. 징병제를 유지하는 한국 사회에서 보통 사람들은 자살한 군인과 유족에게 깊은 공감과 책임감을 느끼지만, 보훈 당국은 전통적인 상무주의 시각에서 자살에 대한 국가책임의 인정에 대해 소극적인 태도를 견지해 왔다. 2012년 대법원 전원합의체 판결은 정신질환을 겪지 않은 군인의 우발적인 자살에 대해 국가책임을 인정함으로써 새로운 전환점을 만들었다. 이 판결을 전후하여 몇 차례 법을 개정하였으나 보훈법제는 아직 규범적 정합성이나 보편성에 이르지 못했다. 자살 법리의 패러다임은 다음과 같은 두 가지 문제를 어떻게 연결하는지에 있다. 첫 번째 문제는 자살이 자유로운 의지의 결정인지 아닌지이다. 두 번째 문제는 누가 유가족의 생계를 밑받침할 것인지이다. 첫 번째 문제에 대한 판단에 입각하여 두 번째 문제를 해결하는 방식이 윤리적 또는 자유주의적 패러다임이라고 한다면, 첫 번째 문제와 두 번째 문제의 직접적인 연결을 제한하고 두 번째 문제를 주목하는 방식이 사회적 또는 공동체적 패러다임이다. 사회적 또는 공동체적 패러다임은 군인의 자살을 죄책의 문제로 사고하는 대신에 공동체가 인수해야 할 불가피한 위험으로 파악한다. 2022년 의무복무 군인의 자살에 대해 국가책임을 강화하는 법제개혁이 이루어졌다. 아직은 지켜보아야 하겠지만 보훈법제가 윤리적 책임론에서 공동체적 책임론으로 한 걸음 내딛었다고 평가할 수 있다.

Abstract

The purpose of this article is to strengthen the community's responsibility for soldiers' suicide. In Korean society, which maintains the mandatory conscription system, the ordinary people feel a deep compassion and responsibility for the self-destructed soldiers and their bereaved families, but veterans authorities have maintained a passive attitude toward recognition of state responsibility for suicide in traditional martialist view. In 2012, the Supreme Court's en banc ruling changed the existing legal principles by recognizing state responsibility for accidental suicide of soldiers who did not suffer from mental illness. Several law revisions were made before and after this ruling, but the veterans legislation has not yet reached normative consistency or universality. The paradigm of legal principles on suicide lies in connecting or disconnecting the following two problems. The first problem is whether suicide is a decision of free will or not. The second problem is who should socially support livelihood of the bereaved families. If the ethical or liberal paradigm is to solve the second problem based on the judgment of the first problem, the social or community paradigm is to limit the direct linkage between the first and second problems and focus on the second problem. Instead of thinking of suicide as a matter of guilt, the social or community paradigm identifies the suicide of a soldier as an inevitable risk that the community must take over. In 2022, veterans legislation was revised to strengthen state responsibility for the suicide of compulsory soldiers. It remains to be seen, but it can be evaluated that the Veterans legislation has taken a step from ethical responsibility to community responsibility.
