다중흐름모형(MSF)을 적용한 ‘윤창호법’의 형성과정에 관한 연구

본 연구는 Kingdon의 다중흐름모형을 이용하여 ‘윤창호법’이 만들어지는 과정에서 음주운전과 관련된 정책문제의 흐름, 정치의 흐름 및 정책대안의 흐름에 대해서 고찰하고, 정책의 창이 열리게 된 계기와 ‘정책선도자’의 역할에 대해서 분석함으로써 음주운전에 대한 처벌을 강화하는 정책변동의 요인을 고찰하였다. ‘윤창호법’의 형성 및 시행과정에 대한 주요 분석결과는 다음과 같다. 첫째, 정책문제의 흐름 측면에서 보면 ‘윤창호법’이 시행되기 전에도 음주운전으로 적발되는 사례와 음주운전 교통사고로 인한 피해는 지속적으로 발생해 왔으며, 이는 음주운전에 대한 사회적 인식이 낮았기 때문이다. 둘째, 정치의 흐름 측면에서 보면, 제17, 18, 19대 국회에서는 음주운전과 관련된 법률안의 발의가 많지 않았으나 20대 국회에서는 음주운전 관련 법률안 발의가 급증하였으며, 대안채택을 통해서 법률에 반영되는 건수도 증가하였다. 셋째, 정책대안의 흐름 측면에서 보면, 현재의 ‘윤창호법’과 거의 유사한 내용을 담고 있었던 과거의 법률안들이 국회에서 통과되지 못하였으며 이는 정책의 창이 열리지 못했기 때문이다. 넷째, ‘윤창호 사건’을 계기로 음주운전에 대해서 강력하게 대응해야 한다는 여론의 흐름을 반영하여 국회의원, 정부 관료 등의 적극적인 대응으로 정책의 창이 열리게 되었다. 다섯째, 일반 시민들이 정책선도자로서 주도적인 역할을 수행하여 조직적인 여론 형성과 정책결정에 결정적인 영향을 미쳤다.
Abstract
This paper examines the Stream of Problem, the Stream of Politics, and the Stream of Policy Alternatives related to drunk driving in the process of creating the ‘Yoon Chang-ho Act’ using Kingdon’s Multiple Streams Framework. By analyzing the role of ‘Policy Entrepreneur’, the factors of policy change that strengthen penalties for drunk driving were considered. The main analysis results of the formation and implementation process of the ‘Yoon Chang-ho Act’ are as follows. First, in terms of the Stream of Problem, even before the 'Yoon Chang-ho Act' was enforced, cases of drunk driving and damage caused by drunk driving traffic accidents continued to occur, because social awareness of drunk driving was low. Second, in terms of the Stream of Politics, the 17th, 18th, and 19th National Assembly did not have many proposals related to drunk driving, but in their 20th, the number of proposals related to drunk driving increased rapidly, and the number of cases reflected in the law through alternative adoption. Also increased. Third, in terms of the Stream of Policy Alternatives, past legislation that contained almost similar contents to the current ‘Yoon Chang-ho Act’ was not passed by the National Assembly, and this is because the window of policy could not be opened. Fourth, reflecting the trend of public opinion that the ‘Yoon Chang-ho incident’ should respond strongly to drunk driving, the window of the policy was opened with active responses from lawmakers and government officials. Fifth, ordinary citizens played a leading role as ‘Policy Entrepreneur’ and had a decisive influence on the formation of organized public opinion and policy making.
