초록
오랜 세월 해운의 중심지로 발전하여온 영국의 발틱거래소(The Baltic Exchange)의 모토는 “당사자가 한 말은 그 당사자를 구속한다(Our Word Our Bond)”이다.
Abstract
The motto of the Baltic Exchange in U.K. which has been developed in the center of shipping for a long time is "Our Word, Our Bond". This shows the nature of English law in which, if it be proved that the contract was agreed orally by both parties, the contract will be effective. Good faith of shipowners and charterers is important in shipping business. The party who suffered loss, asks the Baltic Exchange or the BIMCO to blacklist the party who breached the contract or circulates same to shipping companies all over the world through the shipbrokers for other shipping companies to keep same in mind for their business. Accordingly, the party who breached the contract should abide by the contract so that he can carry on business with recovery of credit. Of course, it is a different story to take a legal step like arbitration or suit, etc as per the charter party. Although it is important for the parties to abide by the contract, it is unreasonable for the parties to be forced to perform it in the circumstance that it is too difficult for them to do it due to the accident which they never expected at the time of making the contract. They call it "frustration" in U.K. and in U.S.A., they use the words of "supervening impossibility", "impracticability" or "frustration" case by case. Thesedays, the oil price has been increased so rapidly that the shipowners have suffered a lot of loss incurred due to the increase of ship's operation costs. Also, there have been shipping companies which get into danger of bankruptcy due to the rapid fluctuation of shipping market. Shipping companies don't have to suffer a lot of loss if above rapid increase of the oil price or rapid fluctuation of shipping market can be applicable to the frustration of the charter party. I will review and analyze the frustration in the charter party including the rapid increase of oil price. This study is significent in that it will contribute to provide the materials for the educational purpose for the shipping company in Korea to manage same legally in case the counter party in charter party tries to frustrate the charter party due to the rapid increase of oil price, etc.
