국제해협의 통과통항제도와 호르무즈 해협의 법적 쟁점에 관한 연구

유엔해양법협약의 발효 이후 국제교통로로서 중요한 역할을 하고 있는 국제해협에는 기존의 무해통항제도 보다 더 자유로운 통항이 보장되는 통과통항제도가 확립되었다. 그러나 아직도 해협 통항과 관련하여 해협이용국과 해협연안국 간에 많은 이해관계가 충돌하고 있다. 또한 일부 해협연안국은 영해범위의 확대 또는 자국 안보 및 환경오염의 우려 등을 이유로 국제해협을 봉쇄하거나 선박의 통항을 규제 또는 제한하려는 경향을 보이고 있어 해협 통항문제의 심각성을 더하고 있다. 특히 최근에는 해협연안국인 이란이 전 세계 원유 해상수송량의 35～40%가 통과하는 페르시아 만의 주요 원유 수송로인 호르무즈 해협을 봉쇄하겠다고 위협하고 있어 우리나라뿐만 아니라 전 세계 경제에 큰 충격을 주고 있다. 따라서 이 논문에서는 국제해협의 통과통항제도와 최근에 심각한 문제가 되고 있는 호르무즈 해협의 봉쇄 위협에 대한 주요 법적 쟁점사항을 고찰하고자 한다.
Abstract
After the effectuation of the United Nations Convention on the Law of the Sea, the transit passage regime that guarantees free passage more than the existing innocent passage is established in international straits that plays an important role as an international traffic route. However, interests related to the strait passage between strait using countries and coastal states of straits still collide. In addition, parts of coastal states of straits show the tendency to block the international straits or regulate or restrict passage of ships with concern about the expansion of the scopes of closes seas or security of their own countries and environmental pollution so that the strait passage issues become more serious. In particular, Iran, a coastal state of a strait has been recently threatening to block the Hormuz Strait, a major crude oil transportation route in the Persian Gulf through which 35～40% of the total crude oil maritime transport amount of the world passes giving a shock to the world economy including our country. Consequently, this paper is going to explore the transit passage regime of the international straits and the major legal issues on the blockade threat of the Hormuz Strait that now becomes a serious problem.
