Abstract
The hardship doctrine mainly aims to minimize possible confusions and social costs which may accompany a rapid or unexpected social changes. While many countries which had previously experienced unforeseen societal changes have adopted this doctrine as a general provision of law into their civil codes, the “Civil Act” of Korea still does not have such a provision. Considering the fact that Korea is one of the countries which underwent the most rapid changes throughout the past several decades, this seems to be unusual. In this paper, I discussed whether it is necessary to have a general provision on the hardship doctrine in the Korean Civil Act, and if so, how the provision should be drafted. For this purpose, first, I explained the definition of the hardship doctrine and expose the global trend towards its acceptance. Secondly, I summarized the relevant legal provisions, case law and scholarly discussions in Korea with regard to the doctrine. I also introduced the two public draft provisions prepared for its introduction into the Korean Civil Act. Thirdly, I explored, analyzed and compared the existing diverse versions of hardship provisions in detail. Lastly and for the sake of the conclusion of this paper, I suggested my own draft provision which I think will be the most suitable for the Korean Civil Act. I hope that this paper can serve to expending the scope of review to many other of hardship provisions unknown or little known to us so that we could find the best model for the Korean hardship provision.
