Abstract

Contracts and inheritance are the most representative legal relationships in which the succession of property between individuals takes place. Among these, inheritance is the most typical case of succession of property according to the provisions of the law, and in addition to inheritance, the property of the deceased person transferred to the heir or a designated person through trust or insurance. Furthermore, the survivors' pension paid according to the Pension Act and the Special Act to protect the bereaved family is considered as a succession of property resulting from the death of the ancestor. Therefore, through this paper, I comprehensively reviewed the contents of the succession of property in the case of the death of an ancestor. Inheritance is a representative legal relationship of property succession and has already studied in detail, so in this paper, the scope of heirs and inherited property was examined, and bequests were examined as well. And I also looked at the trust in which the heir can determine the successor of the property and the attribution of insurance money paid when the heir dies. Furthermore, I looked at the attribution of survivors' pension or survivors' benefits paid to survivors according to the provisions of the law. Through this study, I tried to reveal that although legal relationships other than inheritance each have an independent status, they relate to each other in that they are the succession of property acquired due to the death of the ancestor. Because 60 years have passed since the civil law regulations on inheritance came into force, and various aspects of property succession have developed during that time, I would like to suggest a conclusion that the relationship between each system must be established.
