항만국관할권의 효율적 행사에 관한 연구

항만국관할권은 항만국의 이익 즉 관세, 출입국관리, 위생, 국가안보 혹은 기타의 목적을 위해 일정한 통제를 행할 수 있으며, 또한 해상에서의 안전이나 해양환경보호 등을 위해 자국 항만에 기항하는 외국선박이 각종 국내적 및 국제적 기술수준에 부합하는지 또는 외국선박이 해상에서 불법행위에 종사하지 못하게 하기 위한 통제를 행함으로써 자국뿐만 아니라, 국제사회 전체의 이익을 위해서도 매우 중요한 역할을 하고 있다. 특히, 이러한 항만국관할권의 범위는 계속적으로 확장하고 있으며, 그 역할의 중요성이 강조되고 있다. 하지만, 항만국주의에 한 관할권의 행사의 경우에도 편의항만국의 존재와 기타 사유에 의해 동 관할권의 행사가 제한되고 있다. 이에 이 논문에서는 항만국관할권의 기능이나 목적을 저해할 수 있는 문제점을 제거하고 이를 효율적으로 행사할 수 있는 방안에 대해 검토한다.
Abstract
The effective exercising of Port state jurisdiction plays an important role in relation to not the interests of port state including such as customs, immigration, sanitation, national security and etc. but also the interests of international community including such as foreign ships' compliance with international treaties which aim the safety of ship and protection of marine environment and controlling the illegal act which is carried out by foreign ships at sea. Moreover, the scope of port state jurisdiction is getting bigger and the role of port state jurisdiction is getting important. However, there are some problems which ruins the role and function of port state jurisdiction such as port of convenience and other reasons. Thus, this paper examines the measure to eliminate the problems which harm the role and function of port state jurisdiction and suggests the process which can improve the effectiveness of port state jurisdiction.
