해양시설 기인 해양오염 대응을 위한 국제협약에 관한 연구

해양시설 기인 해양오염은 그 규모가 매우 크고 심각하다. 이러한 해양시설 기인 해양오염에 대응하기 위해서는 체계적인 제도적 준비가 필요하다. 물론 해양오염과 관련된 여러 협약들이 존재한다. 하지만 해양오염과 관련된 기존의 국제협약을 해양시설에 그대로 적용하기에는 여러 가지 검토가 필요하다. 이 연구에서는 해양시설의 법적 성격 검토, MARPOL 73/78, 1972 LC 등 해양오염방지와 관련된 국제협약의 분석과 해양시설에의 적용 가능성을 검토한 후, 해양시설 기인 해양오염에 효율적으로 대응할 수 있는 방안에 대해 고찰하였다. 연구결과 선박성이 인정되지 않는 해양시설 기인 해양오염에 대응하기 위해서 기존 협약들의 적용범위 확대와 지역방제체제의 구축이라는 방안을 제시하였다.
Abstract
Marine pollution from offshore units is a serious problem on a very extensive scale. It is essential to prepare for systematic legalization in order to respond to such an urgent matter. Naturally, there are several existing international conventions regarding marine pollution; however, a review is necessary to examine the existing conventions before applying them to offshore units as it is. This paper explores legal nature of offshore units and analyzes the conventions regarding marine pollution such as MARPOL 73/78 and 1972 LC and their applicability to offshore units. This paper also suggests effective plans for dealing with marine pollution from offshore units as follows: expansion of application scope of the existing conventions and construction of local marine pollution preventing systems.
