Abstract
In the Nottebohm case, which involved a claim of Liechtenstein against Guatemala, in respect of the expropriation of property and imprisonment of Mr. Nottebohm, ICJ reached a rather controversial decision. The Court concluded that the State could not exercise the right of diplomatic protection in respect of related individual without the individual’s genuine connection with the State which assumes the defense of its citizen by means of protection as against other States. Nottebohm, however, contrary to the widespread argument, did have effective links with Liechtenstein. In fact, Nottebohm, who lost his German nationality in consequence of his naturalization, has never invoked the protection of any State other than Liechtenstein. The principle of effective nationality has been created in cases of dual nationality in order to choose one of them, the most effective one. But,when the individual has but one nationality, the application of this principle could have the consequence of rendering him stateless at international level. It is noteworthy that stateless is to be avoided in international law. Entangled with such various theoretical limits, Nottebohm's genuine link theory has been in retreat for some time even in the diplomatic espousal context in which it arose. However, the criticism of the ‘genuine link’theory is acceptable only in the case of applying the genuine link theory with extreme formalistic criteria. The importance of the connection between the State and the related individual cannot be disregarded in the contemporary international law system. A legal bond having as its basis a social fact of attachment, a genuine connection of existence, interests and sentiments are indispensable elements in considering nationality. But, it is not desirable to overestimate the genuine link theory as a prerequisite of diplomatic protection. The right of diplomatic protection is obviously the right of States, not of individuals. This fiction is, however, no more than a means to an end, the end being the protection of the rights of an injured national. The basis of an action in diplomatic protection is the injury to a its national. In other words, the main objective of diplomatic protection is after all to remedy to an injury or damage produced to an individual. We need correspond to the change in dogma of diplomatic protection which is gradually moving from State’s rights to human rights by making the State exercise the right, rather than by applying a excessive and unreasonable criteria, ‘genuine link’.
