초록
The ongoing debate centered around the scope of the currentcounter-terrorism regime and lack of the effectiveimplementation of specific counter-terrorism conventions are theresult of the discrepancy between the Arab states group and theWestern states group on the exclusion of the exercise ofpeople’s right to self-determination and/or of state’s armedforces from the scope of international terrorism. Especially, inthe course of negotiating the Comprehensive Convention onInternational Terrorism (CCIT), the two groups have failed tocompromise their different stances, rather still engagingthemselves in an early stage debate over which and whose actsare to be excluded from the CCIT. This intense discord pointsus towards the desirable role of the CCIT: to provide a door toset a clear-cut boundary between a peacetime counter-terrorismregime and a counter-terrorism regime during armed conflict. States can limit the scope of the CCIT to peacetime terrorismonly, while terrorism during armed conflict is governed byinternational humanitarian law (IHL). A high-level conference, aneed for which was raised in the course of the discussion on theCCIT, would be the best place for addressing the issue ofenhancing effectiveness of both regimes respectively.
