전통한옥 보존을 위한 정책실험- 개발권양도제를 중심으로 -

최근 개발권양도제에 대한 관심이 학계와 실무계를 중심으로 커지고 있다. 과도한 토지이용규제의 손실보전수단으로서, 도시계획 손익조정수단으로서, 용도지역지구제의 한계를 보완해주는 수단으로서, 도심재정비사업 추진 수단으로서의 개발권양도제의 순기능에 주목하고 있는 것이다. 행위제한을 중심으로 문화재를 보존하는 현행제도로는 효과적으로 문화재를 보존할 수 없다고 보고, 도심문화재의 효율적인 보전방안으로서 개발권양도제의 적용가능성을 분석하였고, 이를 위해 종로구 도심문화재 가운데 사적으로 소유되고 있는 민속자료를 사례로 개략적인 정책모의실험을 시도하였다. 개발권양도제의 기본원리를 통해 전통한옥을 효과적으로 보존할 수 있음을 보여주고자 하였다. 모의정책실험에 동원된 두 가지 개발권 평가방식 미이용 용적방식과 지가차액방식 을 이용하여 어떤 방식이 수용지역에 적은 부담을 주는지를 비교했다. 그 결과 미이용 용적방식에 비해 지가차액방식을 통한 개발권 산정방안이 수용지역에서의 추가개발에 따른 부담이 적어 개발권 이전이 용이한 것으로 나타났다.
Abstract
Recently Transferable Developement Rights(TDRs) have attracted interest from policy-makers and academics in Korea. This interest raises questions about the applicability of the TDR within the Korean context. This is closely related to the limitation of zoning system as a means of land use regulation. This study aims at testing the American version of TDR within Korean context with special reference to protecting cultural assets, such as traditional Korean-style houses located in downtown, and suggesting policy implications through schematic policy simulations. Two ways of appraisal of development right, that is, a floor-area-ratio method and a land-price method were used in this policy simulations. As a result, this study shows that traditional houses can be preserved by using the basic principles of the TDR in Korea. This study concludes that the land-price method is better than the floor-area-ratio method because the former relieves the burden of additional development in receiving areas where development rights are transfered.
