중국 재생가능에너지법에대한 고찰

Abstract

As the leading energy producer and consumer, China is facing very complex situation in energy issues. “Law of the People’s Republic of China on Regenerable Energies” should ensure energy security, improve energy efficiency, slow energy consume and strengthen energy environmental protection. As the comprehensive law in energy field, “Law of the People’s Republic of China on Regenerable Energies” should deal with some significant, overall, and strategic problem that other separate energy legislations haven’t covered or can’t solve, for example, energy safety, energy efficiency, energy regulation, energy environmental protection etc. “Law of the People’s Republic of China on Regenerable Energies” should be harmonized with environmental protection, and it’s essential to seep sustainable development concept into “Law of the People’s Republic of China on Regenerable Energies”, specifically, seeping the requirements of sustainable development fully into such basic value concepts of “Law of the People’s Republic of China on Regenerable Energies” as financial order, financial efficiency and financial fairness. It has stated that disclosure of contingencies, including environmental ones, that may reasonably have a material impact on the company’s financial statements. In regard to this increasing progressive regulation on environmental disclosure in foreign countries, including U.S, China government should recognize these trends and need of this kind of information from the investor. The basic purpose of the “Law of the People’s Republic of China on Regenerable Energies” is to protect the investor. The environmental disclosure issues are becoming essential information source in the decision of investment by investors. In China, we have no disclosure regulation on environmental information by “Law of the People’s Republic of China on Regenerable Energies”. However this disclosure based regulation concerning environmental management is worth while to study and consider to adopt in the future.
