탈중앙화 자기주권신원인증(DID) 에 대한 법적 고찰

Abstract

As the economic and social value of data increased, the data economy becamedemocratized and the concept of “data sovereignty” emerged, and individuals neededdata sovereignty to use information with control over their own information and toexpand their own decision-making rights. This means that the data provided byindividuals with such information sovereignty (i.e., by exercising their right toself-determination of information provision) will only be collected and utilized by theentity with confidence. Korea’s major policies reflecting the strengthening of datasovereignty include 1) strengthening the right to self-determination of informationsubjects through the introduction of personal information movement rights,2) introducing command rights to suspend data transfers, 3) strengthening overseasrelocation protection. Self-Sovereign Identifier, the theme of this paper, is a concept emerging as anadvancement of blockchain technology, and is a new paradigm in which individualscan manage/use identity with sovereignty without third party intervention. Thus,Self-Sovereign Identity (SSI) can be seen as somewhat indicative of the applicationof the concept of ‘enhancing self- sovereignty’. Self-sustaining identity verification isa way for individuals to have their own information and identify themselves, unlikebefore. Until now, companies (agencies) issuing accounts have held personalinformation and certified individuals’ identities, which are controversial in their dataownership. This is because companies (agencies) can manage information onindividual activities that occurred during the service use. Self-Sovereign Identity (SSI)is a major solution to this problem.
