보조금(state aid)의 문제는 정치적으로 밀접한 관계에 있으며, 유럽의 상황도 예외는 아니다. 특히 유럽에서 20세기 중반까지만 하더라도 보조금은 일반적인 정부활동으로 인식되어 왔다. 그러나 무역에서의 제한이 없어진다할지라도 유럽연합 각 회원국의 정보보조금이 만연하게 된다면 역내무역에영향을 줄 뿐만 아니라 경쟁에도 상당한 영향을 미치는 것으로 판단되어 온것이 사실이다. 따라서 유럽위원회(EU Commission)는 경쟁과 회원국간 자유무역에 상당히 영향을 미치지 않는 한도 내에서 각 회원국에서 이루어지는보조금을 허용하여 왔다. 위원회의 보조금에 따른 경쟁정책의 발전을 위해,최근에 환경보호와 관련된 보조금제한을 포함하여 전반적인 보조금경쟁규칙을 개혁한다는 발표가 있었다. 이러한 보조금경쟁규칙의 개혁은, 보다 간단하면서 집중적인 방식을 통해 현재의 금융위기를 해결하고 동시에 유럽에서경제부흥을 도모하고자 하는 목적을 가지고 있다. 무엇보다 이러한 개정의 노력은 현재의 규칙보다 명확한 기준을 도입하여효율적인 방법으로 보조금경쟁규칙을 개정하려는 목적을 두고 있다. 그러므로 현재의 보조금규제를 개선하기 위해 보다 발전된 규제구조의 내용을 이론화시킬 필요가 있으며, 이러한 개정은 보조금의 긍정적 효과와 부정적 효과의 상쇄를 효율적으로 심사하는 방법을 통해 이루어져야 할 것이다. 카르텔이나 시장지배적 지위의 남용을 금지하는 유럽기능조약 제101조와102조의 집행에 대해서는 국내에서도 연구가 많이 이루어진 반면, 유럽에서의 보조금경쟁규칙은 실무에서 상당히 중요함에도 불구하고 제대로 연구가이루어지지 않았다. 실제 유럽연합 회원국들을 통해 보조금혜택을 받은 국내기업이 있으며, 한－EU FTA 이후 그 숫자가 지속적으로 증가할 것으로예상된다. 따라서 본 연구는 전체적인 보조금경쟁규칙의 현대화(modernisation)에서 환경보호를 위한 보조금에 관한 규제를 살펴보고 유럽에서의 보조금 허용기준(threshold)에 대한 의견을 제시하고자 한다.
