환경 영역에서의 법적 규제 방식은 종래의 명령과 통제라는 직접적 방식에서 금융시장을 통한 규제방식, 시장을 통하여 기업들이 경제규제를 준수하게끔 경제적 인센티브를 부여하는 방식, 그리고 각종 환경정보를 공개하는 방식 등의 간접적 방식으로 그 중심이 이동하고 있다. 이 중 환경정보를 공개하는 방식의 예로서는 기업의 환경 위반 사항이나 환경 준수사항 등에 관한 관련 행정청의 정보공시나 환경 관련 정보를 재무정보 등에 포함시켜 공시하도록 증권 관련 법령에 법제화하는 방식을 들 수 있다. 우리나라의 경우 강제적 환경정보 공시제도를 채택하고 있는 미국과 달리 증권 관련 법규상으로 환경정보 공시제도를 도입하지 않고 있으나 환경규제의 실효성을 거두기 위해서는 환경정보 공시제도를 증권관련 법령에 도입하는 것이 바람직하며 이 경우 강제할 것인지 여부, 공시되는 정보의 범위, 그리고 그 공시에 대한 감독 등에 관한 법적 뒷받침이 필요할 것이다.
Abstract
Recently environmental regulation is moving from the method by command and control to the disclosure of environmental information. The disclosure of environmental information support the protection of environment and useful way of environmental regulation to the corporation, especially. Acts referring to securities in the United States adopted the mandatory corporate disclosure system. The legislation of mandatory disclosure of environmental information including the forward-looking information and non-financial information at the securities act is encouraged for the protection of environment at the private sector, the corporation.
