선박 기인 황산화물 배출규제 강화에 따른 LNG 벙커링 제도 도입의 법적 쟁점

2016년 10월 런던에서 개최된 제70회 MEPC회의에서 IMO는 2020년까지 선박으로부터 발생하는 황산화물의 배출량을 현행 3.5%m/m에서 0.5%m/m까지 제한할 것임을 밝혔다. 이에 대응하기 위한 방안으로 해외 주요 항만 국가들은 선박연료를 LNG로 전환하기 위한 법제적 정비를 서두르고 있다. 해양수산부는 항만기본계획을 통하여 LNG 추진선박의 활성화가 국제적 환경규제 강화에 대한 대안임을 밝히며, 선박에 LNG를 공급하는 서비스를 도입할 것을 제시한 바 있다. 우리나라에서도 지난 몇 년간 LNG 벙커링의 제도적 도입에 대하여 적지 않은 논의가 있었으나, 「항만운송사업법」상 선박급유업의 명칭을 선박연료공급업으로 변경한 것과 「해운법」에 따라 선박연료공급선이 영업구역의 제한을 받지 않도록 한 것 외에는 별다른 법제 정비가 눈에 띄지 않는다. 최근 「환경친화적 선박의 개발 및 보급 촉진에 관한 법률」이 제정되었으나, 법률의 내용이 LNG 벙커링에 대한 적극적 도입을 예정하고 있다고 보기는 어렵다. 비교법 대상 국가인 유럽연합･싱가포르･일본의 경우, 국가 차원에서 새로운 동력원인 대체연료의 다양한 활용성을 열어두고 있으며, 그 중에서 LNG의 활용 가능성에 크게 주목하고 있다. 이들 국가에는 LNG 벙커링만을 위한 독자적인 법령이 존재하지는 않지만, LNG 벙커링의 신속한 제도 마련을 위하여 기술 및 안전 등에 관한 실무기준을 마련하여 시행하고 있다. 본 연구에서는 선박으로부터의 오염물질 배출규제 강화라는 국제적 추세에 맞추어, 우리나라 LNG 벙커링의 제도화를 위한 법제 개선방안으로서 다음 사항을 제안한다. 첫째, ‘선박용 연료’에 대한 정의 규정을 신설하여 LNG의 포함 여부를 명확히 밝힐 필요가 있다. 둘째, 「도시가스사업법」의 개정 외에 「항만운송사업법」이나 「해운법」의 개편을 통하여 항만과 해상에서의 벙커링까지 선박연료의 공급영역을 확대할 필요가 있다. 셋째, 「환경친화적 선박의 개발 및 보급 촉진에 관한 법률」에도 LNG 벙커링 인프라 구축 및 활용에 관한 사항을 추가하여 LNG 벙커링의 기반을 마련하면서 LNG 추진선박으로의 교체를 지원할 필요가 있다.
Abstract
At the 70th MEPC(Marine Environment Protection Committee) in London, October 2016, the IMO(International Maritime Organization) announced that it would limit the emissions of sulfur oxides from ships from 3.5% m/m to 0.5% m/m by 2020. As a countermeasure, major port countries are in a hurry to make legislative maintenance to convert ship fuel to LNG. There was a lot of discussions about introduction of LNG bunkering in the past few years in Korea, such as LNG-fueled ships emerged as an alternative to the strengthening of international environmental regulations in the Ministry of Maritime Affairs & Fisheries' port master plan. However, there is no noticeable legislative maintenance except that the fuel supply business has been renamed under the Harbor Transport Business Act and the fuel supply lines are not restricted by the shipping zone under the Marine Transport Act. Recently, the Act on the Promotion of Development and Distribution of Environment- Friendly Vessels was enacted, but the contents of the law are hardly seen for the active introduction of LNG bunkering. In the case of the European Union, Singapore, and Japan, the government is planning to use alternative fuels variously as new power sources, and paying great attention to the possibility of LNG as the most notable fuel. These countries do not have legislation independently dedicated to LNG bunkering. For the quick legal response of the LNG bunkering system, it is effective to establish practical standards on technology and safety, rather than revision of the law. As a legislative improvement plan for the institutionalization of LNG bunkering, I propose the following: First, it is necessary to clarify the inclusion of LNG by establishing a new definition of ‘fuel for ships’; Second, in addition to amendment of the Urban Gas Business Act, it is necessary to expand the bunkering area by reforming the Harbor Transport Business Act and the Marine Transport Act; Third, it is necessary to promote the construction and operation of LNG-fueled ships, as well as the policy of establishing infrastructure related to LNG bunkering by adding matters related to infrastructure construction and management to the Act on the Promotion of Development and Distribution of Environment-Friendly Vessels.
