환경침해에 대한 공법적 규제와 구제에 관한 연구

Abstract

There have recently been made a variety of efforts in environmental infringement in Korea. In particular, there is an emerging regulation that can prevent the environmental infrigement. I will examine systematic regulations of public law when some damages caused by environmental violation take place. When environment is disturbed, public law should restrict the violation and victims(resulting from the environmental infringement)should get reliefs. There are two kinds of reliefs, one of private law and of public law. This study is limited on the latter. Now, many neighboring residents, who live around facilities emitting environment pollution, are damaged directly or indirectly. But they don't get proper compensation. In addition, appropriate salvation institutions are not executed. In this reason, this study is try to handle regulations of public law on the damages resultion from environmental infringement.
