Abstract
The purpose of this paper was analyze the contact of current Soil Protection Law(Soil Environment Conservation Act : SECA) and suggest the improvement of legislation and legal policy for soil contamination based on the analysis of korean current situation. Korean legal policy of soil contamination have problems as follows : establishing methodology and process of legal liability distribution and compensation, establishing a legal process to redeem any benefit derived from remediation of contaminated site with the public budget, activation national and international research on soil contamination prevention law. Comparison of the legal policies of countries chosen suggested improvements regarding korean major problems. However, fair suggestions for legal improvement of soil contamination policy were derived from the comparative analyses of countries. My legal suggestions are not yet conclusive due to a lack of legal theory of environmental law.
