Abstract
This paper attempts to analyze Lieberman Warner Bill of 2008 in its relations with GATT/WTO law on trade. The main focus is whether the carbon tariff under the Lieberman Warner Bill on the imports to the US can be regarded as legal under GATT/WTO law. The conclusion is that although carbon tariff of the bill is unilateral and discriminatory and, as a result, violates GATT 3.2, it could also meet the GATT 20(g) General Exception. Even if the bill meets the 20(g) requirements, however, it must also pass the test of chapeau of the Exception. The bill contained several provisions that may not pass the muster of the chapeau. Since the chapeau is more of procedural fairness, however, the carbon tax may be able to avoid the violation by even handed handling of administration the law or by providing due process type procedural measures to the concerned parties.
