나고야의정서 국내이행을 위한 한국의 입법추진동향과 과제

지난 2014년 10월 12일, 나고야의정서가 발효되었다. 나고야의정서 비준국의 대다수는 유전자원 제공국이지만, 유럽연합, 덴마크, 노르웨이, 스위스 등과 같이 이용국에 가까운 국가들도 일부 포함되어 있다. 우리나라는 아직까지 나고야의정서에 비준하고 있지 않다. 2014년 10월 23일, 나고야의정서의 국내 이행을 위한 목적으로 “유전자원 접근 및 이익 공유에 관한 법률안”이 국회에 제출되어 현재 환경노동위원회에 계류되어 있기는 하지만, 나고야의정서 비준 및 국내 이행입법으로 인한 국내 관련 연구개발 및 산업의 위축을 우려하는 목소리도 만만치 않아 나고야의정서 비준 및 이행입법 제정이 순조롭게 이루어질 수 있을지 의문스러운 상황이다. 나고야의정서 자체가 “창의적 모호함 속의 걸작”이라고 평가되고 있음에 비추어 알 수 있듯이, 수많은 쟁점 가운데 합의를 도출하기 곤란한 부분은 아예 삭제하거나 모호하게 규정함으로써 의정서가 채택된 탓에, 동일한 조문을 두고도 첨예한 해석상의 차이가 발생할 수 있는 여지가 남아 있는바, 이는 나고야의정서 비준 및 국내 이행입법 제정을 더욱 어렵게 하는 요인이 되고 있다. 이 글에서는 나고야의정서의 국내 이행에 있어서 특히 주의를 기울여야 할 고려사항을 검토하고, 나고야의정서 이행상의 주요 쟁점을 중심으로 최근 발 빠르게 이행입법을 추진하고 있는 국가의 입법논의동향을 분석하고, 이에 터 잡아 현재 국회에 계류 중인 “유전자원의 접근 및 이익 공유에 관한 법률안”을 평가함으로써 나고야의정서의 국내 이행을 위한 앞으로의 법적 과제를 제시하고 있다. 특히, 입법의 필요성과 형식, 주요 개념의 정의, 적용범위, 국내 유전자원 접근에 대한 사전통보승인 및 상호합의조건의 체결, 국내 유전자원에 대한 접근 및 이용의 금지ㆍ제한, 해외 유전자원 접근에 대한 사전통보승인 취득 및 상호합의조건 체결의 의무화, 해외 유전자원 이용자의 신고의무 및 그에 대한 조사ㆍ권고, 국가책임기관 및 점검기관의 지정 등의 주요 쟁점별로 입법론을 제시하고 있다.
Abstract
The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization to the Convention on Biological Diversity(“Nagoya Protocol”) became effective on 12 October 2014. Nevertheless, Korea, as a user country of genetic resources, has difficulty in ratifying and implementing the Nagoya Protocol, as a “masterpiece in creative ambiguity”. Recognizing importance of benefit-sharing from genetic resources, as a key incentive for biodiversity conservation, Korean Government(Ministry of Environment) introduced a bill, “Act on Access to and Benefit-Sharing of Genetic Resources”, to National Assembly on 23 October 2014. I analyzed main provisions as well as negotiating history and core issues of the Nagoya Protocol, foreign legal systems moving towards domestic implementation of the Nagoya Protocol, and Korean bill called “Act on Access to and Benfit-Sharing of Genetic Resources”. Based on these analyses, I presented some concrete ways to improve the bill, implementing the Nagoya Protocol more effectively and systematically. Especially, I focused on whether and how to require Prior Informed Consent(“PIC”) to access their genetic resources or associated traditional knowledge, how to confirm the acquisition of PIC from countries of origin of imported genetic resources or from provider country of such resources, as well as establishment of Mutually Agreed Terms(“MATs”), and how to establish legal systems to monitor the utilization of foreign genetic resource or associated traditional knowledge.
