유인부합적 금융감독체계 구축방안

금융감독체계의 개편에 대한 논의는 대단히 중요한 것이지만 자칫 기관 이기주의 때문에 그 논의가 왜곡될 수 있다. 본 논문에서는 현대 재무이론에서 표준적으로 인정되는 성과보수함수의 특성과 감독 유인간의 관계를 이용하여 금융감독체계의 개편논의를 재정리하였다. 현대 재무이론에 의하면 무담보 채권자는 채무자의 위험추구 행위를 견제할 자연스러운 재무적 유인을 가진다. 현실의 감독기구 중에서 이런 성격을 가진 감독기구는 개별 금융기관의 부실과 관련해서는 예금보험공사가, 체제적 위기와 관련해서는 한국은행이 그러하다. 이에 비해 금융위원회나 금융감독원은 실정법의 규정에 의한 감독 의무 이외에 이들 기관과 같은 자연스러운 재무적 감독유인은 별도로 가지고 있지 않다. 따라서 본 논문에서는 금융위원회와 금융감독원은 상시적 감독 기능을 수행하되, 개별 금융기관의 부실시에는 예금보험공사가, 그리고 체제적 위기시에는 한국은행이 위기 감독기구로 기능하는 것이 유인부합적이라고 주장하였다. 그리고 금융소비자 보호 기능은 건전성 감독 기능과 상충가능성이 있으므로 별도의 기구로 분리할 것을 제안하였다.
Abstract
Many agree that redesigning financial supervisory structure is important. The policy debate, however, is often distorted due to self interest of involved financial regulators. This paper tries to present an orderly argument on this issue from incentive theory point of view. Modern finance theory argues that unsecured creditors generally are very much interested in monitoring excessive risk taking of the borrower. This feature can be applied to the optimal design of financial supervisory structure. The main idea is that a regulator whose cash flow stream resembles that of a typical unsecured creditor should have the supervisory power. In real world, those regulators are the deposit insurance agency in the case of isolated financial crisis, or the central bank in the case of systemic crisis. Hence this paper propose that during financial crisis, KDIC or BOK should exercise more supervisory power than allowed currently.
