노후 지역난방 사용자 설비 현대화 법제 개선방안 연구

본 연구는 집단에너지의 행정책임과 지속가능성 관점에서 에너지, 주택, 건축, 계량, 기계 의안과 법령을 분석하고, 노후 지역난방 사용자 설비의 현대화 입법을 제안하였다. 지역난방 사용자 설비 현대화를 위한 주요 입법 과제는 다음과 같다. 첫째, 지역난방 사용자 설비 현대화 정책의 성과, 과정, 절차에 대한 행정책임의 체계적 배분이 필요하다. 지역난방 생산자와 소비자로 이원화되어 있는 현재의 관리 입법 구조하에서는 관리주체의 책임 한계가 모호하다. 둘째, 국가나 지자체가 지역난방 사용자 설비의 효율 개선을 지원할 수 있게 하고, 사업자 또는 기계설비유지관리자가 사용자 시설의 사용 중 정기검사를 할 수 있도록 권한과 의무를 규정하는 것이 필요하다. 셋째, 지역난방 사용자 설비 현대화를 위한 가격 차별 메커니즘을 도입할 필요가 있다. 사업자의 집단에너지 공급 확대만을 지원하는 현재의 법제 구조는 행정책임과 지속가능성을 확보하기에는 한계가 있으므로 관련 법제의 제･개정이 요구된다.
Abstract
This study analyzed energy, housing, construction, metering, machinery bills and laws from the perspective of administrative responsibility and sustainability and proposed modernization legislatioin for old district heating user facilities. The main legislative tasks for modernization of district heating user facilities are as follows. First, it is necessary to systematically allocate administrative responsibility for the performance, process, and procedure of the district heating user facility modernization policy. Second, it is necessary to stipulate the authority and obligation so that the state or local government can support the improvement of the efficiency of district heating user equipment, and that the businessoperator or machine equipment maintenance manager can perform periodic inspections during the use of user facilities. Third, it is necessary to introduce a price discrimination mechanism to modernize district heatinguser facilities. The revision of the relevant legal system is required.
