무역항에서의 우선피항선의 법적 지위 및 입법론에 관한 고찰

우리 법제상 잡종선 내지 우선피항선은 그 개념 자체가 난해하고 복잡하다는 입법론적 문제점을 안고 있다. 잡종선 내지 우선피항선의 개념정의에 관한 규정은 여러 차례에 걸쳐 개정되어 왔지만, 여전히 우선피항선의 개념 자체가 모호하고, 우선피항선 관련 규정의 재판규범 및 행위규범으로서의 효력을 현저히 저하시키고 있다. 잡종선 등에 관한 규정의 배경에는 항내 교통상황에 익숙하지 못하고 조종성능도 좋지 않은 잡종선 이외의 선박에 항해상 우선권을 주어 대형선박이 안심하고 출입항 할 수 있도록 하자는 ‘대형선우선원칙’이 있다고 본다. 그러나 선박의 운동성능 등을 전혀 고려하지 않고 일정한 용도나 부류의 선박을 잡종선 등으로 분류한 후, 이들 선박에 대해 타 선박에 대한 일반적 피항의무를 부과하는 것은 법집행의 혼란만 초래할 수 있다. 따라서 우선피항선에 관한 선박입출항법 제2조와 제16조는 폐지하고, 조종성능의 우열에 따라 우선권을 부여하고 있는 국제규칙 제18조를 적용하는 것이 타당하다.
Abstract
The Preferred Give-way Vessels defined by the Korean on the Ships Arrival and Sailing Act were designed to regulate and to promote safety of maritime transportation within the trading port. In the background of the regulation on the preferred give-way vessels, there are thoughts that those vessels are superior on the ship's maneuverability than that of large vessel and the navigator of those vessel is well acquainted with the situation of the port area than other vessels. However, even with the serial revision of the definition, it is still unclear what miscellaneous vessels are. This means any provisions of statute which governs the meaning of miscellaneous vessels lack of it power as to be a standard of ruling and a standard of conduct. Conclusively, section 2 and 16 of the Ships Arrival and Sailing Act shall be repealed, and Article 18 of The International Regulations for Preventing Collisions at Sea 1972 should be adapted.
