Abstract

This study analyzes whether or not the consumer rights guaranteed by several related laws and regulations are restricted for ordinances that provide the conditions of use of sports facilities established and operated by local governments. The targets of analysis shall be limited to Seoul, Gyeonggi, and Incheon among the ordinances that establish and operate the sports facilities, and the provision related to usage fees among the municipal ordinances that establish and operate the sports facilities will be analyzed. Through this analysis, this article would like to find ordinances that restrict consumer rights and propose legislative improvements to enhance consumer rights. In order to the purpose of the study, the legal relationship between the use of sports facilities established and operated by local governments shall be analyzed and related laws and regulations shall be examined. If a local govern-ment is the subject of providing sports facilities, it will examine whether its users can be viewed as consumers. It analyzes the provisions on the return of usage fees of the Ordinance from a consumer's point of view to derive problematic cases and proposes legislative improvement measures.
