인류발전 속도에 따라 에너지소모가 급증하여 인류는 자원의 고갈 위기에 직면하고 있다. 따라서 대체 에너지를 찾고 청정에너지, 재생에너지를 개발하는 것이 인류의 공통된 과제로서 국제적으로 이슈화되고 있으며, 이와 관련하여 경제발전과 에너지의 소비를 조화시키고 지구온난화를 억제를 이루기 위한 국제사회의 노력도 가시화되고 있다. 이러한 배경하에서 중국은 2005년 2월 28일에 <<중화인민공화국 재생가능에너지법>>(이하 “재상에너지법”이라 함)을 제정하여 2006년 1월 1일부터 시행하고 있다. 당해 법률은 중국의 재생에너지 관련 기본법으로서 재상에너지발전의 양적 목표, 상응하는 보장제도 및 법집행의 메커니즘을 수립함으로써 중국 재생에너지산업의 발전을 위한 법적 기반을 제공하고 있다. 따라서 이 글은 중국의 개혁·개방이래 재생에너지법제의 발전과정에 대하여 고찰과 정리를 한 기초위에서 중국 재생에너지법의 입법형식, 기본구조, 주요내용 및 부속 법률체계에 대하여 검토함으로써 현행 중국 재생에너지법제의 기본체계를 논술하였다. 중국 재생에너지법이 비록 중국의 재생에너지산업발전을 위한 법적 조건을 마련하였지만 법체계의 문제점 등 입법상의 문제점이 존재할 뿐만 아니라 시장, 기술, 산업화정도, 에너지전략의 제정 및 대중들의 의식수준 등 면에서 재생에너지법의 실행에서의 적지 않은 제약요소가 존재한다고 하겠다. 따라서 이 글은 이러한 문제점에 비추어 중국 재생에너지법제의 개선에 대하여 나름대로의 의견을 제시하였다. 즉 재생에너지감독관리체제를 개선하여야 하고 재생에너지입법의 내용에 있어서 정부, 시장, 사회의 역할을 결합함으로써 재생에너지산업의 경제적 효율성과 사회적 공평을 추구하여야 하며, 각종 재생에너지 기술유형에 따른 분류입법을 함으로써 재생에너지법의 부속법규를 체계화하고 지방성 입법을 강화하여야 한다.
Abstract
This Article is intended to identify the potential problems inherently existing in Korea's Far-Distance Fishing Industry Act in satisfying the Agreement on Port State Measures to Prevent, Deter, and Eliminate Illegal, Unreported and Unregulated Fishing, and suggest some solutions to them. The IUU Agreement came from the deep concern about the continuation of illegal, unreported and unregulated fishing and its detrimental effect upon fish stocks, marine ecosystems and the livelihoods of legitimate fishers, and the increasing need for food security on a global basis. It also recognizes that measures to combat illegal, unreported and unregulated fishing should build on the primary responsibility of flag States and use all available jurisdiction in accordance with international law, including port State measures, coastal State measures, market related measures and measures to ensure that nationals do not support or engage in illegal, unreported and unregulated fishing. However, the reality evidences that port State measures provide a powerful and cost-effective means of preventing, deterring and eliminating illegal, unreported and unregulated fishing.
