우리나라는 아직 의약품의 온라인 판매를 금지하고 있다. 하지만 다수의 외국국가들은 소위 인터넷 약국(internet pharmacy)을 통한 의약품의 온라인 판매를 허용하고 있고, 특히 인근의 일본과 중국도 최근 일반의약품의 온라인 판매를허용하기 시작했다. 이 연구에서는 우리나라, 미국, 일본의 의약품 온라인 판매현황과 규제를 살펴보고, 앞으로 우리나라도 의약품의 온라인 판매를 제도적으로허용하고자 할 경우 고려해야 하는 이슈들을 요약한 정책 로드맵을 그려보고자한다. 이를 위하여 온라인 약국을 (1) 국내에 사업장을 갖는 적법한 온라인 약국, (2) 악성 온라인 약국, (3) 국내에 사업장이 없지만 외국에서 적법하게 운영되는온라인 약국으로 3분하는 프레임워크를 채택하고 각각에 대한 정책적 고려사항을 제시한다.
Abstract
Online sale of medicine is completely prohibited in Korea. This policy is in stark contrast to some other countries that have permitted internet pharmacies. The prime example is Korea’s neighbors - Japan and China. This article compares the regulations of internet pharmacy in Korea, the U.S. and Japan, and offers policy considerations for Korea should it decide to permit online pharmacy. The author suggests that Korea categorize internet pharmacies into (1) legitimate online pharmacies with domestic presence, (2) rogue internet pharmacies, and (3) legitimate foreign online pharmacies without domestic presence in Korea, and build differential regulation for each category.
