Abstract
Medical Case Reports in medicine involve sharing rare, unusual, or novel clinical cases within the academic community, aiming to advance medical knowledge, foster educational benefits, and provide valuable information that can alert clinicians to potential issues or serve as references for changes in clinical practice. Through these reports, contributions are made to the prevention, diagnosis, and treatment of diseases, ultimately playing a significant role in protecting human life and maintaining health. However, medical case reports have traditionally been regarded as distinct from human subject research, including clinical trials, as they involve sharing information about actual, past clinical events among medical professionals or those engaged in the medical field. This distinction has led to ongoing debate as to whether medical case reports should undergo review by an Institutional Review Board (IRB) under the Bioethics and Safety Act in Korea, and whether informed consent must be obtained in advance from patients whose medical records are utilized for such reports. Nevertheless, medical case reports inevitably involve the disclosure of patient information recorded in medical charts, making it imperative to ensure that the data subject’s right to informational self-determination and the protection of privacy are not infringed, regardless of the medical significance of the reporting activity. Based on this awareness, this study comprehensively reviewed domestic legal frameworks, including the Bioethics and Safety Act, the Personal Information Protection Act, and the Framework Act on Health and Medical Services, as well as international ethical guidelines such as the COPE Guidelines, the Declaration of Helsinki, and the CIOMS Guidelines, in addition to autonomous standards established in academic communities both domestically and internationally. As a result, this study confirmed that medical case reports can indeed fall within the scope of human subject research, and, in principle, sufficient explanations and voluntary informed consent must be obtained from patients. Such consent should include a clear explanation of the purpose of the medical case report, the scope of data to be collected and used, potential risks and benefits, and measures for de-identification. However, it was also clarified that in circumstances where it is practically impossible to obtain consentfor instance, when the patient cannot be contacted or has passed awayexceptions may be permitted through IRB review and approval. Furthermore, it was confirmed that exemptions from obtaining consent may also be granted exceptionally when pseudonymised information is used after review and approval by the Data Review Board.
