북한핵실험의 국제법적 평가

오늘날 핵실험의 통제는 1963년의 부분적핵실험금지조약(Partial Test Ban Treaty), 1974년의 지하핵실험제한조약(Threshold Test Ban Treaty), 1976년의 평화목적지하핵폭발조약(Peaceful Nuclear Explosions Treaty) 및 1996년의 포괄적핵실험금지조약(Comprehensive Test Ban Treaty) 등에 의해 실현되고 있다. 이러한 상황하에서, 북한이 2006년 10월 9일 오전 10시 36분경 함경북도 길주시 화대리 인근에서 지하핵실험을 감행하였고, 이에 대응하여 UN안전보장이사회가 ‘북한핵실험에 대한 대북제재결의(제1718호)’를 채택하여 북한을 압박하고 있다. 이러한 ‘북한지하핵실험’을 둘러싼 전개과정에서, 당면한 최고의 과제는 어떻게 하면 북한의 핵실험문제를 합리적으로 해결할 것인가 하는 점이다. 이를 위해서는 다양한 해결방안이 제시될 수 있을 것으로 판단되는 바, ‘북한핵실험이 과연 적법한 행위인가의 여부’에 관해 고민해 보는 것도 매우 유용한 노력이 될 것으로 판단된다. 따라서 본 논문에서는 아래의 몇 가지 측면을 고찰해 보고자 한다. 먼저 ‘Ⅱ’에서는 핵실험의 규제에 관한 국제법 체계, 즉 핵실험규제에 관한 제조약들의 주요내용과 그 한계를 검토하고자 한다. 둘째 ‘Ⅲ’에서는 이러한 검토를 바탕으로 해서 ‘북한지하핵실험의 위법성 여부’를 검토하고자 한다. 끝으로 ‘Ⅳ’에서는 이상과 같은 평가를 기초로 북한지하핵실험문제의 합리적 해결방안을 제시해 보고자 한다. 이상과 같은 검토와 분석을 통해 본 논문에서는 다음과 같은 결론을 제시하고자 한다. 북한의 지하핵실험을 직접적으로 금지할 수 있는 일반적 조약이 존재하지 않는다는 점에서, 북한의 지하핵실험을 위법하다고 단정하기에는 논리적 비약이 포함될 수 있다는 우려가 있다. 동시에 아직 CTBT에 비준하지 않은 국가는 동 조약의 조속한 발효를 위하여 비준을 하여야 함과 아울러 무엇보다도 핵실험의 통제가 당해 국가 뿐 아니라 국제사회 전체의 이익과 부합한다는 점을 널리 인식하여야 할 것이다.
Abstract
All of nuclear weapons test have been controlled by the Partial Test Ban Treaty in 1963, the Threshold Test Ban Treaty in 1974, the Peaceful Nuclear Explosions Treaty in 1976 and the Comprehensive Test Ban Treaty in 1996.Under the existing conditions, a underground nuclear weapons test had been conducted at 10 : 36 am, in Hwaderi, near Kilju City, in North Hamkyung province by North Korea. And be faced with this test, U.N. Security Council has oppressed the North Korea with its resolution 1718. In process of the deployment of the test, most important task is to search the reasonable ways to resolve the test problem. And then it is very useful to decide whether the test is legal or not. Accordingly this paper deals with the followings. Firstly part ‘Ⅱ’ explores the main contents and limits of the treaties to control a nuclear weapons test. Secondly part ‘Ⅲ’ examines whether the underground nuclear weapons test by North Korea is lawful or not. Lastly part ‘Ⅳ’ presents a reasonable ways to resolve the problem of the North Korea's nuclear weapons test. Through the discussion and analysis above mentioned, this paper presents some conclusions as followings. Because there is no general treaties to prohibit the North Korea's underground nuclear weapons test directly, it can't conclude the test is illegal. Simultaneously each country have not ratified yet must ratify the CTBT in order for it to enter into force as soon as possible, and perceive that the control of nuclear weapons test agree to not only the profit of each country but also of the world.
