대법원이 2014년 이혼에 따른 재산분할과 관련하여 아직 발생하지 아니한 연금도 현재의 재산분할의 목적재산으로 인정함에 따라 공무원연금법 등에도 연금분할제도를 도입하려는 입법적 움직임이 있고, 아울러 향후 연금의 분할과 관련한 많은 복잡한 문제들이 야기될 것으로 예상된다. 이와 같은 상황 하에서 우리와 유사한 연금제도를 운영하고 있는 캐나다의 경우 판례 및 법령으로 연금의 종류 (확정급여형연금 인지 혹은 확정기여형연금인지)에 따라 어떻게 연금을 분할할 지, 연금분할시 어떤 방식에 의하여 이를 평가할 것인지에 관하여 은퇴를 의제하여 가치를 평가할 것인지 혹은 이혼 후 있을 수 있는 다양한 요소를 고려하여 실제로 은퇴가 있을 당시를 기준으로 가치를 평가할 지, 나아가 연금의 실제가치를 평가함에 있어 산술적 증가를 전제로 하는 방식을 취할 지, 기하학적 증가를 전제로 하는 평가방식을 취하여야 할 지 등에 관하여 문제가 될 법적 논의에 대하여 다양한 해결방법을 시도하며 그 이론을 발전시켜 왔다. 우리 대법원판례의 판결취지에도 캐나다의 현재의 이와 같은 연금분할이론과 궤를 같이 하는 내용이 포함되어 있어 앞으로 우리의 연금분할제도 운영- 그 중에서도 특히 퇴직연금제도와 관련하여 - 에 많은 도움이 될 것으로 보인다. 또한 캐나다의 연금분할방식중 크레딧분할방식과 연금의 등분은 이혼배우자의 사망으로 인한 연금수급권의 상실의 문제나 사실상 이혼단계에서 연금을 분할할 필요가 있는 경우 등 우리법제상 미비한 부분을 보완할 수 있는 수단이므로 입법적으로 반영을 적극 검토할 필요가 있다.
Abstract
In a Korean Supreme Court Case in 2014, the Court held that pensions that are to be received in the future should be included in the assets subject to a division resulting from a divorce. As a result, legislative efforts are being made to introduce pension benefit division system in certain applicable laws such as the Act on Pension Funds for Public Officials, etc., and it is anticipated that the introduction of such systems will give rise to a lot of complicated issues. Under the current circumstances in Korea, it would be a meaningful exercise to review the Canadian system since Canada implements a pension system similar to that being operated in Korea. Canada has developed the relevant theories through court precedents and legislations and considered, among others, how to divide pension benefits by pension types (defined benefit pension plan or defined contribution pension plan), what method will be used at the time of division of pension benefits such as calculating the pension amount presuming that the pensioner has retired at the time of the divorce (termination method) or based on the value at the time of actual retirement taking into account various factors after the divorce (retirement method), as well as whether to take pro-rata method or value-added method in evaluating the actual value of the pension fund. Given that the Korean Supreme Court’s decision also includes theories similar to those developed in Canada, the Canadian system will likely provide some degree of guidance as to how Korea should adopt and implement a system of dividing pension benefits, particularly with respect to the retirement pension plan system. Moreover, among the Canadian pension benefit division systems, Korea may consider legislative steps to adopt “credit splitting” and “pension sharing” systems, which relate to possible loss of pension rights when a former spouse deceases or when dividing pension benefit is necessary even if the situation has not elevated to a divorce, since these systems could supplement the areas that are legislatively insufficient under the current Korean system
