Abstract

The United Nations Convention on the Law of the Sea defines the island to be "a naturally formed area of land, surrounded by water, which is above water at high tide", and recognizes the exclusive economic zone and continental shelf around the island except rocks "which cannot sustain human habitation or economic life of their own". International disputes about islands could be identified as follows: a dispute over the sovereignty of the island; a dispute over the effect of islands in the determination of maritime delimitation; a dispute over the allocation of maritime spaces to islands. Dispute over sovereignty of the islands and delimitation have been settled by international judicial bodies or direct negotiations, or remains unsettled. The United States with a lot of offshore islands have experienced dispute concerning sovereignty or maritime delimitation. The U.S. settled island sovereignty disputes with Honduras, Colombia, Kiribati, Tuvalu, Cook Islands, New Zealand by concluding bilateral agreements in 1970s. The U.S. renounced the sovereignty over the disputed islands in order to strength the bonds of peace and friendship between them but was entitled to use military or navigational facilities erected on the islands in spite of sovereignty renunciation. But sovereignty dispute over Machias Seal Island between US and Canada remains not to be solved. Nevertheless the dispute between them have not been aggravated because they use this island and surrounding waters. The United States remains some maritime delimitation in Juan de Fuca Strait, Dixon Entrance and Beaufort Sea not to be unsettled. On the other hand delimitation in the Gulf of Maine has been settled by the International Court of Justice in 1979. We can see the US policy to settle the dispute with vital economic interests by the international dispute resolution mechanism such as the International Court of Justice. It is quite interesting to notice US policy over the sovereignty dispute of islands. The United States renounced the island sovereignty to the developing countries for the peace and friendship. Is it so naive to suggest for the Super Powers to renounce the sovereignty to the small and underdeveloped countries if there are sovereignty disputes between them?
