Abstract
Btcoin is based on a revolutionary technology that was first proposed in a paper written by Satoshi Nakamoto. This paper proposed a network that would enable individuals to transact eletronic currency without interposing a third party. Unlike legal tender, governments do not issue bitcoins, but instead a decentralized network of computers does so. Bitcoin does not rely on a third party, such as a bank, to verify transactions. Instead the ledger, known as the blockchain, is distributed throughout a network of computers so that the verification of transactions is decentralized. A person's bitcoin account number is identified as a series of numbers and letters. This alphanumeric string is known as the public address. It is called public because anyone with access to the blockchain can view the balance of the address, as well as any transactions that go in and out of the address. What allows an individual to own a certain public address is his ownership of a private key associated with that address. If an individual has the private key, he can spend the bitcoins recorded in the associated public address. Each of the transactions to and from public addresses is contained on the blockchain, which establishes how many bitcoins each public address has. When considering whether the law should regulate Bitcoin or not and how regulate it, it was common to explore legal nature of bitcoin in private law at the forehand step. Is it a commodity? A currency? A security? For example, there has been a lot of attention on questions of how to tax Bitcoins, of how they interact with payment-processing regulations, and so forth. There has been relatively little attention on the pure private-law questions that Bitcoin raises. This article attempts to address private law questions concerning Bitcoin.
