많은 사람들이 디지털 공간에서 기록물을 생산하며, 개인이 사망한뒤 남는 디지털 기록물의 양도 늘어났다. 그런데 고인이 남긴 디지털기록은 물리적 실체를 가진 기록유산과 다르다. 고인의 기록이 고인만의 것이 아닌 경우도 많고, 고인이 생전에 온라인 계정과 디지털 기록처리 방식을 밝히지 않는 경우도 많아, 이런 문제는 유족 등에 대한 상속의 문제로 이어지게 될 수도 있다. 또한 소프트웨어 문제, 특정 플랫폼의 이용약관, 유족에 의한 계정 삭제 등의 사유로 개인 사후 디지털기록이 방치 또는 삭제될 수 있다. 이는 당시 사회상을 알 수 있는 중요한 단서가 되는 일상 기록이 쉽게 소실되는 문제로도 이어진다. 개인들이 본인의 디지털 기록 보존에 관심이 있지만 마땅한 방법을몰라 소극적인 방임(benign neglect)을 하고 있음이 몇몇 연구를 통해 드러났다. 이 때문에 개인 디지털 기록과 개인 사후 디지털 기록에 관심을 기울이고, 관련 정책과 계획을 마련할 필요가 있다. 이에, 본 연구는개인 사후 디지털 기록의 관리와 관련하여 법과 제도, 플랫폼과 산업의현황 및 정책, 개인 기록관리 현황 등과 관련하여 문제점을 분석하고, 법의 제정 및 플랫폼 약관의 명시 필요성, 기록관리기관의 디지털 개인기록 관리 방안, 개인의 사후 기록에 대한 선제적 관리방안 및 디지털계정 정보 관련 유언장 작성 방법 등 다양한 해결방안을 제안하였다.
Abstract
Many people create records in digital space, and the amount of digital records left after individual dies has increased. The digital record left by the deceased is different from the record heritage that has physical substances. In many cases, the records of the deceased not just belong to the deceased, and many deceased did not explicitly disclose 개인의 사후 디지털 기록관리를 위한 정책과 방안 167 their online accounts and method of dispose of digital records during their lifetime, so this problem may lead to problems of inheritance to the bereaved family. In addition, digital records may be neglected or deleted after a person’s death due to software problems, specific platform’s terms of use, account deletion by bereaved family, etc. This leads to the problem that daily records, which are important clues to the social aspects at the time, are easily lost. Several studies have revealed that individuals are interested in preserving their digital records, but do not know how to do it, so they are benign neglect. For this reason, it is necessary to pay attention to personal digital records and personal digital legacy, and to prepare related policies and plans. Accordingly, this study analyzes problems related to the management of digital records after an individual’s death, related to laws and systems, the status and policies of platforms and industries, the status of personal record management, etc. Various solutions were suggested, such as a need for enactment for digital personal record management act, platform’s explicit policy for individual’s post-mortem records, digital records management plan for archival institutions, individual’s a preemptive management plan for his/her own records, and a method for writing a will related to digital account information
