카지노의 자금세탁방지를 위한 외환검사권 강화 방안

최근 자본시장 확대와 외환시장의 점진적 개방과 더불어 대규모의 자금이 국가간에 경제적·비경제적인 방법으로 이동하고 있다. 카지노 사업은 현금 이용비율이 높고 자금회전이 빠르므로 특히 자금세탁의 위험에 누출되기 쉽다. 또한 카지노의 금융서비스는 은행과 기타 예금기관들이 제공하는 서비스와 유사하여 입금, 신용 제공, 자금이체, 수표 교환, 환전 등을 포함하고 있다. 우리나라 카지노는 내국인 출입 제한조치로 인해 미국 카지노처럼 카지노 칩을 현금처럼 사용하여 자금을 세탁하는 행위는 없으나, 카지노 고객에게 국내 사업장에서 신용대출을 하고 그 대출금을 현지에서 회수하여 오는 과정에서 자금이 세탁될 개연성이 높다. 우리나라 자금세탁방지 업무 체계는 금융정보분석원을 중심으로 정보의 수집, 분석, 제공과 협의거래를 금융기관 등으로부터 보고 받고 있다. 그리고 법집행기관에 특정금융정보를 제공하고 받기도 한다. 특히 법집집행기관 가운데 관세청이 역할이 큰 비중을 차지하고 있다. 따라서 관세청의 외환검사권을 강화시킬 필요성이 제기된다. 관세청은 조세행정기관으로 본연의 역할을 수행하는 것도 중요하지만, 외환자유화에 따른 자유화의 속도를 조절하고 그 자유화의 부작용인 외화도피·자금세탁 등을 방지하는 역할도 수행해야 할 것을 기대한다.
Abstract
Casions are cash-intensive business that often provide financial services and money laundering opportunities. The exchange of cash for casion chips and related money transfer and accound services make casions vulnerable to money laundering. Casinos in the Republic of Korea don't launder money by using casino chips as currency like US casinos because residents' entrance to the facility is restricted. Korea Casinos make a loan contract with their customers who are nonresidents in the casino facilities located in the Republic of Korea and than the casinos employees collect for claims and bring them to the Republic of Korea from abroad. It is easy to launder money in that process. The research on casinos located in the jeju island say that the size of the currency is 10% of the total sales. Although Inspection competence of foreign exchange affairs give the Commissioner of the Korea Customs Service in that high-probability of money laundering fields, the Commissioner of the Korea Customs Service have no authority to inspect the fields. there is a limit to disclose that money because the Commissioner of the Korea Customs Service and their staff should conduct the inspection against only parties to and persons concerned in export and import transactions and service transactions and capital transactions directly related thereto. It is proper that the Korea Customs service should be given the inspection right about Foreign Exchange Transactions Act article17(Permission, etc of Export and Import of Means of Payment). but it is hard to gain the right. on the preferential basis, the Korea Customs service should have the inspection right on casinos money changers.
