Abstract
As cyber threats grow increasingly sophisticated, the adoption of active cyber defense strategies has become a critical priority in national security agendas worldwide, including South Korea. While extensive debates and research have highlighted the necessity of active cyber defense, insufficient attention has been paid to the issue of legal liability faced by practitioners executing such measures. This study addresses this gap by proposing the introduction of an immunity framework for practitioners engaged in active cyber defense operations. The research first identifies the necessity of practitioner immunity and the associated legal and policy challenges in the implementation of active defense strategies. It then examines international discussions and comparative practices related to immunity mechanisms, before presenting concrete policy recommendations for establishing a practitioner immunity system tailored to the South Korean context.
