리스본조약상 유럽위원회의 구조와 권한

유럽의 지역통합은 정치가, 학자, 시민단체, 국가 등 다양한 주체들에 의해 심화ㆍ확대되어 왔다. 하지만 EECㆍECㆍEU로 이어지는 지역공동체 운영의 중심축을 담당한 것은 다름 아닌 EU의 기관들(institutions), 그 가운데서도 특히 유럽위원회(European Commission)(이하 ‘위원회’라 한다)라고 할 수 있다. 유럽연합조약(Treaty on the European Union: TEU) 제17조 1항에 의하면, 위원회는 EU의 일반적 이익(the general interest of the EU)을 촉진하기 위하여 활동하는 기관으로서 유럽역내시장을 실질적으로 운영하고, 제정책의 이행 여부를 감시ㆍ감독하는 역할을 수행하고 있다. 이와 같은 임무와 더불어 위원회는 그 권한 행사의 하나로 ‘입법제안권’을 행사한다. 이에 대해 TEU 제17조 2항은, “제조약에서 달리 규정하고 있지 않다면, 연합의 입법행위는 오직 위원회의 제안에 의해서만 제정될 수 있다. 기타의 행위는 제조약에 규정되어 있는 경우에만 위원회의 제안에 의하여 제정된다”고 규정하고 있다. 그러나 기존의 EC조약과는 달리, 리스본조약은 위원회의 ‘독점적(혹은 배타적) 입법제안권’을 인정하고 있지는 않다. 이와 같이 위원회는 폭넓은 범위에 걸쳐 막대한 역할 내지는 권한을 행사하고 있어 유럽의 통합 과정은 물론 역내시장의 운영에 있어 핵심적인 임무를 수행하고 있다.
Abstract
The regional integration in Europe has been deepened and developed by the several actors as politicians, scholars, NGOs and States. But It was the EU institutions, in particular, the European Commission(hereafter “the Commission”), which have played an important role for functioning the european regional communities. According to the article 17, paragraph 1 of the Treaty on the European Union(TEU), the Commission is an institution to promote the general interest of the EU, to manage in reality the internal market, and to carry out a role observe and supervise the economic actors. With the above missions, the Commission has the competence of right to propose the legislative act. The article 17, paragraph 2 stipulates that “Union legislative acts may only be adopted on the basis of a Commission proposal, except where the Treaties provide otherwise. Other acts shall be adopted on the basis of a Commission proposal where the Treaties so provide.” However, contrary to the former Treaty of the European Community, the Treaty of Lisbon doesn't recognise the exclusive conpetence of right to propose the legislative act by the Commission.
