변호사시험제도 등에 대한 평가와 그 개선방안

로스쿨이 개원 10년 만에 1만 884명의 법조인을 양성하면서 법률서비스의 문턱을 낮추고 법조계의 외연을 확장하는 한편 기존 몇몇 대학 중심의 법조계 카르텔을 깨는 견인차 역할을 하는 성과를 낸 것은 사실이지만 그 한계점도 지속적으로 노정(露呈)하고 있다. 가장 주된 원인은 변호사시험제도이다. 로스쿨 교육을 충실히 이수하면 합격할 수 있는 자격시험으로 운영되어야 할 시험이 인위적인 합격률 고정(입학정원 대비 75%) 등으로 인해 기존 사법시험과 다름없이 사실상 선발시험으로 운영되면서 '변시 올인(All-In)' 현상을 초래해 로스쿨 현장은 지금 신림동 학원가로 변질되고 있다. 한편, 법률시장이 포화상태라는 이유로 합격률 상향조정에 반대해 온 변호사업계 주장이 터무니없지만은 않다. 변호사들이 짧은 기간에 지나치게 과다 배출되어 그로 인한 자질부족과 경쟁격화로 불법 수임과 사건 부실처리 등의 부작용이 현실화되고 그로 인한 변호사 징계가 늘어나는 것은 이를 방증한다. 하지만 국민들에게 법조문턱을 낮추고 양질의 법률서비스를 제공한다는 로스쿨의 설립 취지에 비추어 무조건 변시 합격자를 줄이는 것은 결코 능사가 아니다. 자질이 문제된다면 로스쿨 교육과정과 방식의 개선 등으로 푸는 게 합리적이다. 따라서, 일선 로스쿨들이 교육을 통한 경쟁력 있는 법조인의 양성에 대한 사회적 신뢰를 얻기 위해서는 각 로스쿨의 교육과정과 내용이 더 충실해져야 할 뿐만 아니라, 그 교육과정이 변호사시험과도 유기적으로 연계되어 운영되어야 한다. 이를 위해서는 로스쿨 교육과정을 4년제 등으로 개편하거나, 합격자에 대한 사법연수원에서의 추가 실무 교육 도입 및 자격시험으로서의 성격에 맞게 선택과목 등 시험과목을 일부 축소하는 한편, 전국적으로 변호사시험이 시행되며, 시험 응시방법으로 컴퓨터를 활용한 방안 등을 적극 검토하여야 한다.
Abstract
It is true that the law school has produced 10,844 lawyers in 10 years after the opening of the school, while lowering the threshold of legal services, expanding the legal profession and playing the role of breaking the existing legal cartel, (Exposure). The main cause is the current lawyer examination system. All-In examinations have to be conducted as qualification tests that can pass if they successfully complete legal school education, and they are practically selected as they are due to the fixed rate of admission (75% of the admission quota) ) 'Phenomenon, and the law school education is changing into the examination technical education. It is not unreasonable to argue that the lawyer industry has been opposed to raising the passing rate because the legal market is saturated. This is evidenced by the fact that the lawyers are over-discharged in a short period of time, and the lack of qualities and the intensification of competition have caused the adverse effects such as the illegal order and the mismanagement of the cases to be realized. However, in light of the intention of the law school to lower the threshold of the law and to provide quality legal services to the people, it is by no means to reduce the number of successful applicants. If quality is a problem, it is reasonable to solve it by improving the law school curriculum and method. Therefore, in order for the primary law schools to gain social trust in the training of competent lawyers through education, the curriculum and content of each law school should be made more faithful, and the curriculum must be linked to the lawyer exam . In order to do this, the law school curriculum should be reorganized into four-year courses, or some of the test subjects such as elective courses should be reduced in accordance with the qualifications of the qualification test.
