국민건강증진을 위한 음주규제의 법정책과 입법방안 - 우리나라, 미국, 영국, 프랑스를 중심으로 -

세계 여러 나라가 해로운 음주를 감소시켜 사회경제적 폐해를 줄이기 위한 법정책적 노력을 강화하고 있으며, 많은 연구에서 법규제가 음주폐해 방지 및 감소에 효과적임이 입증되고 있다. 우리나라의 음주소비량이 많음에도 불구하고, 음주규제를 위한 법정책이 단편적이며 이를 체계적으로 운영할 법체계와 관할 행정조직의 미비 등이 문제로 지적되고 있다. 본 연구에서는 2008년 세계보건기구에서 정한 ‘음주폐해 감소를 위한 9가지 전략’을 검토의 기준으로 우리나라의 음주규제에 관한 법정책의 체계, 수준, 방식 등을 검토하였으며, 이를 위해 음주규제의 선진국으로 알려진 미국, 영국, 프랑스의 음주규제 법령을 비교 검토 후 음주규제의 법정책 내용을 입법론적 관점에서 제시하였다. 첫째, 네 개 나라의 음주규제 대두배경과 관할 법령 및 행정부서를 비교검토 하였으며, 둘째, 각국의 법정책을 9개 영역 즉, 인식증진 정책, 보건의료서비스 대응, 지역사회 활동, 음주운전, 음주 가능성, 주류 마케팅, 가격정책, 폐해 감소, 불법주류에 의한 폐해 감소 영역별로 비교분석하였다. 그 결과 법체계의 개선방안으로 주류행정을 총괄할 (가칭)주류관리법 및 독립 행정부서 설립을 제안하였으며, 입법정책 내용으로 학교 음주예방교육의 강화, 지역사회 알코올 상담센터 법적근거 마련, 지역사회 연대활동 강화, 음주운전예방 프로그램 다양화, 주류판매 및 구매 제한, 주류광고 감시, 주세의 건강부담금 과세, 판매거부제도, 불법제조 주류유통 감시제도의 필요성을 제시하였다.
Abstract
This study was designed to recommend national policy related to the alcohol regulation to Korean government based on the comparative analysis of foreign countries laws & regulations on alcohol. Data related to the national regulation and policies were collected by four countries' article, text, web, regulations and consultation from experts. The reforms of national regulation on alcohol were recommended based on the analysis of the countries' legal system. The items of each area are 9 targets as follows; raising awareness and political commitment, health-sector response, community action to reduce the harmful use of alcohol, drink-driving policies and countermeasures, addressing the availability of alcohol, addressing marketing of alcoholic beverages, pricing policies, harm Reduction, reducing the public health impact of illegally and informally produced alcohol. The comparative analysis showed that some complements are needed for governmental Alcohol Administration Bill. For the reduction of economic and social costs, legal program have to fulfill these indicators to achieve the 9 targets. In conclusion, the results of this study will contribute to revise the states and improve the national regulation system for to reduce the harmful use of alcohol in Korea.
