보호자의 소생술 거부에 따른 구급대원의 소생술 유보 의료지도 요청에 대한 법적 고찰

우리나라 구급대원의 응급처치는 구급지도의사의 의료지도 하에 이루어진다. 그 중 소생술 유보는 구급대원이 현장에서 사망선언을 할 수 없어 직접의료지도가 반드시 필요한 항목이다. 소생술 중지(유보 및 중단)를 위한 지침에는 의학적 무의미함의 원칙과 자율성 존중의 원칙이 있다. 소생술이 심장기능 회복에 도움이 되지 않고, 환자가 소생술을 원치 않았던 것이 명백하다면 소생술 유보나 중단은 정당화 될 수 있다. 그러나 119 구조ㆍ구급에 관한 법률에 따른 현행 구급대원의 현장응급처치 표준지침에는 보호자의 소생술 유보 요청이 있을 때 구급대원은 구급지도의사에게 의료지도를 요청하도록 하고 있다. 사전에 본인의 의사를 지시로 남겨놓는 법적 제도적 장치가 일반화 되어 있지 않은 우리나라에서 보호자에 의한 대리 의사결정은 드물지 않은 일이다. 그러나 심정지 상황에서 구급대원의 보호자 요청에 의한 소생술 유보 의료지도 요청은 그 자체로 의학적 무의미함의 원칙이 되고 있으며, 자율성 존중의 원칙에도 해당되지 않는다. 본 논문에서는 보호자의 소생술 유보 요청에 대한 구급대원의 의료지도의 요청에 대하여 소생술 중지의 원칙 및 법에 따라 검토하고, 국외의 사례를 살펴 제도적 보완점 대해 논의하고자 한다.
Abstract
Korean emergency medical service (EMS) is carried out under the medical oversight of emergency physician medical director. Among the medical oversight, the withhold of resuscitation in prehospital stage is an item that requires direct medical oversight Guideline for cessation of resuscitation (withhold and withdraw) include the two principle of medical futileness and respect for patient’s autonomy. If resuscitation does not recovery patient’s cardiac function, and it is clear that the patient did not wish resuscitation, withhold resuscitation can be justified. However, among the current standard guidelines for on scene EMS for EMS providers, there is a guideline for requesting medical oversight when the guardian request withhold resuscitation. It is common for a guardian to make a decision on behalf of the patient in Korea. However, in patients with cardiac arrest, the request for withhold resuscitation by guardinan is not the case for principle of medical futileness and respect for autonomy. In this study, it will be examined whether the medical oversight request for withhold resuscitation by EMS provider is appropriate, according to the principles of resuscitation cessation and legal aspects and to discuss institutional supplements by examining abroad cases.
