한국 산재보험체계의 과실책임주의 한계와 자치관리운영원리의 활용

한국의 산재보험체계는 산재 인정과정에서부터 피해 보상까지 모든 산재 입증 책임을 재해근로자에게 부여하고 있다. 이로 인해 근로자는 산재피해와 더불어 입증책임까지 근로복지공단에 규명해야 산재보험의 혜택을 제대로 받을 수 있는 어려운 상황에 부닥쳐 있다. 반면, 독일 산재보험체계는 재해근로자의 산재입증이 아닌 자치관리운영권을 가진 산재보험조합 소속 행정직원의 직권으로 절차가 진행된다. 이러한 산재 인정을 둘러싼 한국 근로복지공단의 부조리와 그 실태를 심사과정 관련 통계자료를 분석하여 드러냄으로써 근로자들이 구체적으로 왜 피해를 보게 되는지를 해명하고자 한다. 아울러 독일의 산재보험조합이 건강보험조합과 협력하여 근로자의 산업재해를 효과적으로 보장하는 방법을 병행·분석해 보임으로써 한국의 경우를 객관화시키고자 했다. 이러한 분석을 통해서 한국 산재보험체계의 한계를 극복하고 독일 산재보험체계의 모범을 따라서 모든 근로자가 산재로부터 보호받는 체계로 발전해 갈 수 있는 하나의 계기를 제시하고자 한다. 그것은 국가의 강제보험체계가 아니라 근로자와 사용자의 자치관리운영기구를 활용하는 방식이다. 이는 산재보험의 자치관리운영체계로의 제도개선 방향과 사회적 인식 제고에 기여할 수 있을 것이다.
Abstract
System of Korean Workers’ Compensation Insurance (hereinafter called WCI) is being shifting the responsibility of proving industrial accidents onto the injured. This makes it difficult for the injured workers to properly be compensated. On the other hand, the system of German WCI grants its WCI union self-administrative operating rights and administrative staffs of the union, based on their own judgement, do all the necessary things including the proving industrial accidents on behalf of the injure. We would like to explain why the employees suffer financial damage by analyzing the data concerning the improperness of approving industrial disaster which has been done within Korea Workers' Compensation & Welfare Service German WCI union and German health insurance work in cooperation. By analyzing and juxtaposing the way how this cooperation effectively guarantees their workers’ industrial disaster, we’d like to objectify the way how our WCI handles the same. With these analyses, we’d like to suggest a momentum that we overcome the limitation of Korean WCI and follow the German WCI standard in order for all the workers to be protected from industrial disaster. The method we suggest here is not the compulsory implementation of WCI led by the government, but the way how to mobilize the Self-governing Management system established by the workers and users. This method could help shifting of system change from present rigid WCI to Self-governing Management system of WCI and help contribute to people’s reconsideration toward the improved system.
