现代中国中央与地方关系的变迁及制度化实践

Abstract

China is a big country with a vast territory, a huge population and many ethnic groups. Therefore, central and local government relationship has always been an important issue in national governance processes. Since reform and opening up, China adopted themarket-oriented economic reforms. It stimulates local development dynamic, also forces the central government to delegate power to local. Due to this, local governments have been given more authorities, such as legislative power and financial power from central government. Meanwhile, central government strengthens the supervision and administration of local governments. In the past years, China has tried using Constitution, the Regional Organization Law and Legislation Law to propel this process. However, lack of the basic law to mediate the relationship brings a lot of problems, Such as low transparency of relation between the central and local government, arbitrariness and ruling by man. The key solution to this problem is not only a reasonable division of responsibility, authority and interest between central and local government, but gets a clear institutional provisions. Above all, China should promptly establish and improve the resolution mechanisms for legislative conflict, local financial system and justice system in line with China’s conditions.
