아브라함 카이퍼의 노동문제관 : ‘우리의 강령’과 ‘수공노동’을 중심으로

이 연구는 카이퍼가 노동문제를 어떻게 인식하고 그 해결을 위해 어떤 대안을 제시했던가를, 그의 저작과 연설문에 기초하여 살펴보았다. 그 결과 그가 제시한 기독교적 세계관의 중요 요소인 영역주권론이 노동문제에 대한 그의 인식과 대안 제시에 중요한 틀로 작용하였음을 보았다. 우선, 그는 노동, 노동자들의 삶과 그 조건, 그들의 이해관계를 하나의 독립된 ‘영역’으로 인식하였다. 따라서 그는 노동법전의 제정과, 자본과 분리된 그들의 이익을 대변하는 조직이 필요하다고 보았다. 또한, 그의 영역주권론의 중요한 요소인 ‘국가의 한정된 권능’이라는 개념은 노동문제의 해결에 있어서 하향적, 설계주의적, 국가 개입 방식이 아닌 상향적, 제도적, 계급 간 자발적 타협의 방식을 선호하게 하였다. 그리고, 그의 영역주권론 내에서 국가가 가지는 기능, 즉 영역 간 침해의 방지와 영역별 주권 발휘 보호를 행하기 위한 방식으로 ‘대표’의 원리가 제시되었다. 그 원리를 구현하는 구체적 방안으로는, 상향적 선출에 의해 조직되는 지역단위 노동회의소들 및 전국적 일반 노동회의소의 설립과, 각 이익집단의 대표들로 구성되어 기존의 상원을 대체하는 이해관계원의 설립이 제안되었다. 이러한 그의 구상은 당대에 실현되지는 못하였으나 2차 대전 이후 네덜란드, 스웨덴 등의 북구의 민주적 코포라티즘 체제에서 어느 정도 실현되고 있다고 볼 수 있다. 그의 영역주권론적 사고는 인간 공동체가 풀어야 하는 경제적, 사회적 문제에 대응함에 있어서 시장이냐 국가냐 하는 이분법적 사고에서 벗어나 보다 효과적이고 창의적인 방식을 찾는데 도움을 줄 수 있다.
Abstract
This article studies Kuyper's view on the labor problem and his proposals for its solution with special attention to the relation between his concept of sphere sovereignty and his view on this particular social problem. He recognized labor, laborers' living, and their interest as a distinct sphere, which demands a separate code and organizations to represent laborer's own interest. The concept of State's limited authority made him prefer bottom-up, institutional, and voluntary negotiation approach to solve the problem. As concrete measures to realize the principle of representation, which he advocates as a mean to realize the function of the State to resolve a conflict situation between different spheres, he suggested to organize local ‘chambers of labor’ and a national general chamber of labor and to replace the conventional first chamber with ‘chambers of interests’ where various groups of interests were to be represented. Though not realized in his time, Kuyper's idea can be seen as a forerunner of the democratic corporatism, the concrete forms of which can be found in postwar north European countries such as the Netherlands and Sweden.
