범죄피해자 정보권 보장을 위한 형사절차상 권리 안내의 개선방안 - 현행 경찰단계 제공 「범죄피해자 권리 및 지원 안내서」를 중심으로 -

이 연구는 범죄피해자의 정보권 보장을 위해 형사 절차상 권리 안내의 한계를 분석하고, 개선 방안을 도출하는 것을목적으로 한다. 이를 위해 현행 경찰단계 제공 「범죄피해자 권리 및 지원 안내서」를 중심으로, 권리안내서의 근거규정, 내용 및 교부 실무와 문제점 및 개선방안을 분석하였다. 연구 결과, ① 권리 안내서 내용의 불완전성과 정보제공의 일관성 부족 ② 아동, 청소년 등의 이해도를 고려한 추가 형식 미비 ③ 범죄 피해자 권리 행사 수단에 대한안내 미비 ④ 안내서 교부 시기의 문제 ⑤ 수사관의 권리 고지 방식의 문제를 발견하였다. 범죄 피해자의 권리 행사를보다 효과적으로 보장하기 위해 ① 권리 안내서 항목의 추가 및 상세 기재 ② 아동, 청소년 등의 이해도를 고려한추가 형식 마련 ③ 범죄 피해자의 권리 행사 수단 마련 ④ 안내서 교부 시점의 적시성 확보 ⑤ 범죄 피해자 권리의구두 설명에 대한 수사관 교육 실시와 같은 개선방안을 제안하였다. 이러한 입법 및 정책 도입을 통해 피해자 권리보장에 기여하고, 피해자의 회복에 도움을 줄 수 있기를 기대한다.
Abstract
The aim of this study is to identify the deficiencies in the guidance of rights within criminal procedures and propose improvements to safeguard the information rights of crime victims. This study focuses on the ‘Criminal Victim Rights and Support Guide’ currently provided at the police stage, examining its regulatory framework, assessing content deficiencies, analyzing issuance practices, and pinpointing areas for enhancement. The study identified several key issues : ① Incomplete content and inconsistent delivery of information in the rights guide. ② Lack of formats tailored to the comprehension levels of children and adolescents. ③ Insufficient guidance on the means for crime victims to exercise their rights. ④ Inadequate guidance on the timing of issuing the guide. ⑤ Problems related to investigators’ notification of rights. To enhance the exercise of rights for crime victims, the following measures are proposed : ① Enhancing the detail of information in the rights guide items. ② Developing additional forms designed for children and adolescents’ understanding. ③ Creating mechanisms for crime victims to effectively exercise their rights. ④ Ensuring the guidebook is issued in a timely manner. ⑤ Training investigators to provide oral explanations of crime victims’ rights. It is hoped that the implementation of such legislation and policies will ensure the protection of victims’ rights and facilitate their recovery.
