Abstract
This study aims to examine the legal issues raised during the Corruption Investigation Office for High-ranking Officials (CIO)’s investigative process in the impeachment crisis. Specifically, it analyzes the appropriateness of the investigation process based on factual circumstances, legal interpretations, the relationship between the constitutional non-prosecution privilege under Article 84, and the prioritization of conflicting legal provisions. In reviewing the investigation process, this study confirms that if the underlying offenses committed by different suspects are indivisibly linked through shared factual circumstances, applying the concept of “related crimes” to charges such as abuse of authority and insurrection falls within the scope of legal interpretation. While Article 84 of the Constitution does not explicitly preclude investigations, the absence of established legal standards leaves room for legal disputes. Regarding the conflicts arising during the execution of warrants, this study, through a teleological and systematic interpretation of legal provisions, finds that warrants issued following a review of state functions align with the constitutional principles of warrant-based procedures and equality before the law. Thus, rejecting the execution of such warrants based solely on the Presidential Security Act, which aims to protect the personal safety of the president, is deemed inappropriate. This study further examines the factual circumstances surrounding the CIO’s initiation of the investigation, filtering out misleading media narratives, and systematically presents key legal issues. Ultimately, it seeks to contribute to the stable operation of the criminal justice system and the substantive realization of democratic rule of law, even amidst the turmoil of an impeachment crisis.
