한국에서 자동차 리콜의 구조와 그 문제점: 규제기관의 역할과 자동차 결함 관련 제조물 책임소송의 현황을 중심으로

자동차의 개발규제체계로서 자동차안전기준을 자동차 제조사가 자기인증하는 제도를 취하고 있는 한국에서 자동차의 리콜은 자동차의 결함을 억제해 소비자를 보호하는 핵심적 제도이다. 하지만 유사한 개발체계를 취하고 있는 미국과 비교해 자동차 리콜제도가 원활하게 기능하지 않고 있다는 비판은 한국에서 지속되어 왔다. 이 글은 미국과 비교해 한국의 자동차 리콜 구조, 그 과정에 중대한 영향을 미치는 규제기관의 역할, 그리고 자동차 결함 관련 제조물 책임소송의 현황을 중심으로 한국 자동차 리콜의 문제점을 살펴보았다. 자동차 제조사의 자발적 리콜이 중심이 될 수밖에 없는 자동차 리콜에서 미국고속도로교통안전청에 비해 상대적으로 취약한 규제기관의 역할과 자동차 제조사의 자발적 리콜에 상당한 영향을 미치는 자동차 결함 관련 제조물 책임소송이 극히 부진한 점이 한국의 자동차 리콜 구조에서는 두드러진다. 자동차 결함 관련 제조물 책임소송이 활성화되기 어려운 한국 제조물 책임법의 여러 가지 요인들 비추어보면 자동차 제조사의 자발적 리콜을 촉진하기 위한 자동차 결함 조사에 관한 규제기관의 역량 강화가 그 무엇보다 필요하다.
Abstract
Automotive recall is essential part of reducing defects in automobile to protect consumer in Korea's regulatory framework on the development of automobile in which motor vehicle makers self-certifies observance of Motor Vehicle Safety Standards during development. However, criticism that automotive recall does not work properly in comparison with U.S. which adopts similar framework has persisted. This paper explores problems of Korea's automotive recall in comparison with U.S., focusing on framework of Korea's automotive recall process and role of regulatory agency, status of product liability lawsuits on automotive defects which affects largely automotive recall. Relatively weak role of regulatory agency comparing with The National Highway Traffic Safety Administration and sluggishness of product liability lawsuits on automotive defects which prod voluntary recall of moto vehicle makers composing most of automotive recall stark out in Korea's automotive recall compared with U.S. Empowering investigation of automotive defects of regulatory agency in Korea's automotive recall process is urgent considering various causes in Korea's product liability law which dampen product liability lawsuits on automotive defects.
