국가도메인 대외 개방을 위한 인터넷주소법 개정 방향

전 세계적으로 등록되는 일반최상위도메인과 외국에 주소지를 둔 인(人)에게도 등록이 허용된 다른 나라의 국가최상위도메인의 경우에는 지속적인 도메인등록의 증가와 이를 기반으로 한 홈페이지 개설 등으로 인터넷주소 기반 산업이 성장하고 있음에 비하여, 한국의 경우에는 국내에 주소지를 둔 인에 대해서만 국가도메인의 등록을 허용하는 폐쇄적 정책을 고수하여 지난 10여 년간 도메인 등록 수와 그 연관 산업의 정체를 면치 못하고 있다. 이 연구는 2010년대 초반 ICANN이 일반최상위도메인 확대 과정에서 채택한 이의신청제도를 검토하고, 한국이 이 제도의 큰 틀을 차용하되 구체적인 분쟁해결의 판단기준과 절차를 마련함에 있어서는 한국의 현행 법제를 고려하여 적절히 변용할 것을 제안한다. 외국에 주소지를 둔 인의 국가도메인 신청을 허용하고, 인터넷주소 분쟁 조정제도를 통해 오남용에 대응할 것을 제안한다. 이를 위해, 공익위반과 공동체 이익을 저해하는 도메인 등록과 사용에 관한 분쟁조정의 근거, 기준과 절차를 정하는 인터넷주소법 개정안을 구체적으로 제시한다.
Abstract
While the number of registration of gTLDs and open ccTLDs that allowed foreign registration has continued to grow and related industries prosper, Korea has maintained the requirement of ‘domicile in Korea’ for ccTLD registration and resulted in stagnation in the registration number for the last decade. This paper analyzes the objection process in the ICANN’s new gTLD expansion program in the early 2010s. It suggests that Korea should learn lessons from ICANN experiences and adopt a Korean version of the ICANN objection process, which however adjusts detailed procedure and standard of review in dispute resolution taking into account Korea’s existing law and the characteristics of ccTLD. For example, this paper proposes to adopt post-registration regulation of abusive registration or use of domain names instead of pre-registration review of domain applications by foreign residents, and to rely on current alternative UDRP-like dispute resolution system with additional provisions to be stipulated in the Internet Address Resources Act dealing with breach of morality and public order as well as registration or use against the interests of communities associated with the domain name.
